RESOLUTION NO. 439 <br />RESOLUTION OF THE CITY OF SOUTH BEND, DEPARTMENT OF <br />REDEVELOPMENT AUTHORIZING THE FILING OF AN AMENDATORY <br />APPLICATION FOR LOAN AND GRANT FOR PROJECT NO. IND <br />R -57 <br />WHEREAS, it is necessary and in the public interest that the City of South <br />Bend, Department of Redevelopment avail itself of the financial assistance <br />provided by Title I of the Housing Act of 1949, as amended, to carryout <br />the urban renewal project described as the LaSalle Park Urban Renewal Area, <br />and bounded generally as follows. <br />LaSalle Park Project bounded on the west by the alley <br />west of Chicago; bounded on the south by the alley <br />north of Western; bounded on the east by the alley <br />east of Meade; bounded on the north by Kankakee Avenue, <br />Washington Street, the LaSalle Park Beck's Lake Park <br />area, and Linden Street. <br />hereinafter referred to as the "Project "; and <br />WHEREAS, it is recognized that the Federal contract for such financial <br />assistance, pursuant to said Title I, will impose certain obligations <br />and responsibilities upon the Local Public Agency and will require among <br />other things: (1) the provision of local grants -in -aid; (2) feasible <br />method for the relocation of individuals and families displaced from the <br />project area; and (3) other local obligations and responsibilities in <br />connection with the undertaking and carrying out of urban renewal projects; <br />and <br />WHEREAS, Title VI of the Civil Rights Act of 1964 and the regulations <br />of the Department of Housing and Urban Development effectuating that Title, <br />provide that no person shall, on the ground of race, color, sex, or <br />national origin, be excluded from participation in, be denied the benefits <br />of, or be subject to discrimination in the undertaking and carrying out <br />of the urban renewal projects assisted under Title I of the Housing Act of <br />1949, as amended; and <br />WHEREAS, the objections of the Urban Renewal Plan cannot be achieved <br />through more extensive rehabilitation of the Project Area: <br />NOW THEREFORE, BE IT RESOLVED by the City of South Bend, Redevelopment <br />Commission: <br />That the United States of America <br />ing and Urban Development be, and <br />of full compliance by the City of <br />Redevelopment with regulations of <br />and Urban Development effectuatin <br />Rights Act of 1964 and applicable <br />and the Secretary of Hous- <br />they hereby are, assured <br />South Bend, Department of <br />the Department of Housing <br />g Title VI of the Civil <br />Executive Orders. <br />2. That an amendatory application on behalf of the City of South <br />Bend, Department of Redevelopment For a loan under Section <br />102 (a) of said Title I in the amount of $4,640,738.00 and <br />for a project capital grant and a relocation grant to the full <br />amount available for undertaking and financing the Project is <br />hereby approved, and that the Executive Director is hereby <br />authorized and directed to execute and to file such application <br />with the Department of Housing and Urban Development, to pro- <br />vide such additional information and to furnish such documents <br />as may be required in behalf of said Department, and to act <br />as the authorized correspondent of the City of South Bend, <br />Department of Redevelopment. <br />
