ORDINANCE NO. J 5 b ~ ~ ~ <br />AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA, ESTABLISHING A NEW SCHEDULE OF RATES AND CHARGES FOR <br />SERVICES RENDERED BY THE CITY OF SOUTH BEND WATER WORKS AND <br />AMENDING CHAPTER 17, ARTICLE 4, SECTIONS 17-45 AND 17-46 <br />OF THE SOUTH BEND MUNICIPAL CODE <br />STATEMENT OF PURPOSE AND INTENT <br />The City of South Bend, Indiana last established a schedule of rates and charges for services <br />rendered by the Water Works by Ordinance No. 9246-01 which was passed on August 27, 2001. <br />Crowe Chizek, a financial consultant to the Board of Public Works, has carefully reviewed <br />the City's rates and charges and has determined that an increase in such rates and charges is <br />necessary to continue to provide quality services. <br />The Common Council has determined that in order to meet the statutory requirements as <br />provided in Indiana Code Section 8-1.5-3-8, it is necessary that the rates and charges be increased <br />for services rendered by the Water Works of the City of South Bend. The Common Council further <br />notes that such rate and charge increases will require the approval of the Indiana Utility Regulatory <br />Commission of the State of Indiana. <br />NOW, THEREFORE, BELT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br />OF SOUTH BEND, INDIANA, AS FOLLOWS: <br />Section I. Chapter 17, Article 4, Section 17-45 of the South Bend Municipal Code shall be, <br />and hereby is, amended to read in its entirety as follows: <br />Sec. 17-45. Water Works rates and charges. <br />There shall be and are hereby established for the use of and the services rendered by the <br />Water Works System of the City of South Bend, the following rates and charges, based upon the use <br />of water and facilities furnished by said Water Works System: <br />Rates <br />(a) Usage per Monthly <br />Billin P <br />Rate per <br />100 Cubic Feet <br />-1- <br />
