'r <br />X9691 <br />confirmed and modified by Resolution No. 635 on March 20, <br />and; <br />1981; <br />amended by Resolution No. 636 on April 16, 1981; <br />confirmed by Resolution No. 641 on June 12, 1981; <br />amended by Resolution No. 648 on November 24, <br />1981; <br />confirmed by Resolution No. 651 on February 5, 1982; <br />amended by Resolution No. 682 on June 27, 1983; <br />confirmed by Resolution No. 688 on August 26, 1983; <br />WHEREAS, to assist in carrying out the Central Downtown <br />Urban Renewal Area (Original) Urban Renewal Plan, the Commission and <br />the City of South Bend (City) entered into an agreement (Agreement) <br />IL with the United States Department of Housing and Urban Development <br />(HUD) for financial assistance in acquisition and rehabilitation of <br />the Central Downtown Urban Renewal Area (Original), through funding <br />under Title I of the Housing Act of 1949, as amended, the project <br />being Project Number R -66, South Bend, Indiana; and <br />WHEREAS, the Commission and City executed a close out <br />agreement with HUD on August 2, 1978, with complete close out <br />effective August 18, 1978, for Project Number Indiana R -66, South <br />Bend, Indiana, and with the following restrictions remaining on <br />property acquired under Project R -66: (a) that proceeds from <br />disposition of real estate acquired under that Agreement be treated <br />as program income pursuant to 24 CFR Part 570; (b) that property be <br />used in accordance with the Urban Renewal Plan; (c) that <br />improvements be begun within a reasonable time; (d) that any <br />proposed reconveyance of property be subject to public disclosure; <br />and (e) that there be no discrimination on the basis of race, color, <br />religion, sex or national origin, in the sale, lease, rental, use or <br />occupancy of any property; and <br />WHEREAS, acquisition of certain property within the Monroe <br />Sample Development Area and the East Bank Development Area was <br />carried out through the assistance of HUD from the proceeds of <br />Section 108 Loans, received from HUD by the City pursuant to <br />promissory notes executed on January 25, 1980, and December 21, <br />-4- <br />
