replanning, rezoning, or redevelopment of the South Bend Central <br />Development Area, indicating any parcels of property to be excluded <br />from acquisition and the parts of the area acquired that are to be <br />devoted to public ways, levees, sewerage, parks, playgrounds, and <br />other public purposes under the development plan for the area; and <br />WHEREAS, lists have been prepared of owners of the various <br />parcels of property proposed to be acquired within the South Bend <br />Central Development Area, and separate appraisals have been made by <br />at least two (2) independent appraisers of the fair value of the <br />parcels proposed to be acquired; <br />WHEREAS, there was presented to this meeting of the <br />Commission for its consideration and approval a copy of the <br />development plan for the South Bend Central Development Area, which <br />plan is dated May 10, 1985, and is entitled South Bend Central <br />Development Area Development Plan, South Bend, Indiana (Plan); <br />WHEREAS, the Plan and the conditions under which the <br />Commission will make relocation payments have been reviewed and <br />considered by the Commission, and the South Bend Central Relocation <br />Policy has been developed by the Commission to address relocation <br />needs for the South Bend Central Development Area; <br />WHEREAS, the development plans for the Monroe Sample <br />Development Area, the East Bank Development Area, and the Central <br />Downtown Urban Renewal Area all need to be amended, merged into and <br />superceded by the Plan; and <br />WHEREAS, Title VI of the Civil Rights Act of 1964, as <br />amended, and HUD regulations effectuating that title provide that no <br />persons shall on the grounds of race, age, sex, color or national <br />origin be excluded from participation in, be denied the benefits of, <br />or be subject to discrimination in the undertaking or carrying out <br />of any federally assisted project; <br />WHEREAS, the Commission by Resolution No. 632 adopted on <br />January 16, 1981 and by Resolution No. 634 adopted on March 2, 1981 <br />established the East Bank Development Allocation Area (South Bend <br />Allocation Area No. 2); and <br />WHEREAS, Resolution No. 632 contained an error as to the <br />effective allocation year and base assessment for property taxes <br />-10- <br />
