REGULAR MEETING JANUARY 28, 2008 <br />BILL NO. 04-08 PUBIC HEARING ON A BILL TO VACATE THE <br />FOLLOWING DESCRIBED PROPERTY: THE <br />FIRST EAST-WEST ALLEY NORTH OF ST. <br />VINCENT STREET FROM THE EAST RIGHT- <br />OF-WAY LINE OF GEORGIANA STREET, TO <br />THE WEST RIGHT-OF-WAY LINE OF BURNS <br />STREET FOR A DISTANCE OF 248 FEET <br />MORE OR LESS AND A WIDTH OF <br />APPROXIMATELY 12 FEET <br />Councilmember Varner made a motion to combine Bill Nos. 1-08; 2-08; 3-08 and 4-08 <br />for the purposes of Public Hearing. Councilmember White seconded the motion which <br />carried by a voice vote of nine (9) ayes. <br />Councilmember Varner, Chairperson, Public Works and Property Vacation Committee, <br />reported that this committee held public hearings on Bill Nos. 1-08; 2-08; 3-08 and 4-08 <br />this afternoon and it was the consensus of the committee to send these bills to the full <br />Council with a favorable recommendation. <br />Mr. Mike Danch, Danch, Harner & Associates, 1643 Commerce Drive, South Bend, <br />Indiana, made the presentation for this bill on behalf of the Petitioners, the University of <br />Notre Dame Du La., Northeast Neighborhood Revitalization Organization, Inc., and the <br />South Bend Heritage Foundation. <br />Mr. Danch advised that the petitioners are requesting the approval of the vacation to <br />allow for the construction of the Eddy Street Commons facility. The proposed project <br />will use the proposed vacated right-of--ways. The City and the Petitioners believe that <br />vacating the right-of--ways will not have a detrimental effect on the adjacent properties. <br />This being the time heretofore set for the Public Hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. <br />Councilmember Rouse disclosed that he is a member of the Northeast Neighborhood <br />Revitalization Organization, Inc. and that after discussion with Council Attorney <br />Kathleen Cekanski-Farrand it was determined that no conflict exists. <br />There being no one present wishing to speak to the Council either in favor of or in <br />opposition to this bill, Councilmember Puzzello made a motion for favorable <br />recommendation of Bill No. 01-08 to full Council concerning this bill. Councilmember <br />Varner seconded the motion which carried by a voice vote of nine (9) ayes. <br />Councilmember White made a motion for favorable recommendation of Bill No. 02-08 <br />to full Council concerning this bill. Councilmember Rouse seconded the motion which <br />carried by a voice vote of nine (9) ayes. <br />Councilmember Varner made a motion for favorable recommendation of Bill No. 03-08 <br />to full Council concerning this bill. Councilmember Rouse seconded the motion which <br />carried by a voice vote of nine (9) ayes. <br />Councilmember Oliver Davis made a motion for favorable recommendation of Bill No. <br />04-08 to full Council concerning this bill. Councilmember Varner seconded the motion <br />which carried by a voice vote of nine (9) ayes. <br />BILL NO. 89-07 PUBLIC HEARING ON A BILL AMENDING <br />ORDINANCE NO. 9791-07 FIXING AND <br />INCREASING MAXIMUM WAGES OF <br />TEAMSTERS EMPLOYEES FOR CALENDAR <br />YEAR 2008 AND APPROVING TEAMSTER <br />EMPLOYEE WAGE FOR 2009-2010 <br />
