RESOLUTION NO. 761 <br />RESOLUTION AMENDING PROCLAIMER CERTIFICATE <br />NO. 2 FOR THE SOUTH BEND CENTRAL DEVELOPMENT <br />AREA AND AMENDING RESOLUTION NO. 753 RELATING <br />TO ACQUISITION OF PROPERTY WITHIN THE SOUTH <br />BEND CENTRAL DEVELOPMENT AREA BY EMINENT <br />DOMAIN. <br />WHEREAS, the South Bend Redevelopment Commission (Commission) <br />did on November 22, 1985 adopt Proclaimer Certificate Number 2 <br />establishing the fair market value of property in the South Bend <br />Central Development Area, including Parcels C15 -14 and C15 -15; and <br />WHEREAS, the Commission did on November 22, 1985 approve <br />Resolution No. 753 authorizing the acquisition of property within <br />the South Bend Central Development Area by eminent domain, including <br />Parcels C15 -14 and C15 -15; and <br />WHEREAS, the fair market value for Parcels C15 -14 and C15 -15 <br />was established to be $8,350.00 and this value was based on <br />appraisals by two qualified, independent, professional real estate <br />appraisers; and <br />WHEREAS, these appraisals were based solely on exterior <br />inspections of the property because the appraisers were unable to <br />gain entry to the property although they had tried repeatedly to do <br />so; and <br />WHEREAS, subsequent to the Commission's actions on November 22, <br />1985, the property owner of Parcels C15 -14 and C15 -15 permitted the <br />appraisers to enter the property and the appraisers have updated <br />their appraisals and submitted a written and signed copy of those <br />updated appraisals; and <br />WHEREAS, each updated appraisal has been reviewed by the <br />Department and no corrections, revisions or additions were <br />requested; and <br />WHEREAS, the Commission wishes to amend the fair market value <br />for Parcels C15 -14 and C15 -15 by amending Proclaimer Certificate No. <br />2 and Resolution No. 753 authorizing a written purchase offer in <br />the amount of the Commission Approved Market Price; <br />NOW THEREFORE, BE IT RESOLVED, by the South Bend Redevelopment <br />Commission, as follows: <br />1. Proclaimer Certificate No. 2 for the South Bend Central <br />Development Area is hereby amended for Parcels C15 -14 <br />and C15 -15 to delete the fair market value therein <br />shown and to add a new fair market value of $9,225.00. <br />2. Resolution No. 753 is hereby amended for Parcel C15 -14 <br />and 15 to delete the Commission Approved Market Price <br />therein shown and to add a new Commission Approved <br />Market Price of $9,225.00. <br />3. Except for the amendments herein made, Proclaimer <br />Certificate No. 2 and Resolution No. 753 remain in all <br />respects as adopted on November 22, 1985. <br />fir•► <br />
