<br />Be It Resolved by the Board° of- Purlit Works of the City of South Bond,
<br />St Joseph Cowtty Slate of IndI&aa, that it is desire# and deemed- aesessary to
<br />improve Calvert ,Street from Michigan Street to the east line of High Street. -as.
<br />follows, to -wit: f
<br />Said street shall be graded and 'the roadway thereof shall be paved;
<br />and also the roadway of certain portions of the streets and alleys which eater or
<br />istorseet'said street shall be graded sat paysi. he paving material to be used
<br />in making said improvement shall be Portland **next concrete pavement seven inches
<br />tkiek.g, Skeet Asphalt, B1tul1t%1s, Aepiaitle concrete or Brisk, and the foudation
<br />skull be Portland cement coasrete ftvAu-00 iackes thick for the Sheet Asphalt
<br />asphaltic concrete, hitulitkie and brisk, or rolled gravel six (6) inches
<br />thick Pot the brisk; also the cement curb now in place OR said street shall be

<br />Public Works of the, City of South'Bend, Indiana.
<br />Tbb Cott bf the improvement herein provided for, eaeept street and alley intersections, shall be paid by
<br />Special assessment to be levied upon the property specially benefitted, to the: amount that the same may be low
<br />ally assessed therefor, in accordance with an Act of the General Assembly Of the State of Indiana, entitled
<br />"An Act. Concerning Mum—'eipal Corporations, approved March 6, 1806, and lu aeoordange with aid pursuant
<br />$o the provisions of all acts amendatory and supplemental thereto.
<br />The ecst of all street and alley intersections, including one-half of the width of the improvement oppo-
<br />afte street snd alleys which run into, but do not cross said roadway herein proposed to be improved and that
<br />'portion of such street or alley abutting upon. property belonging to said City, or upon property not subject to
<br />such assessment, shall be paid by the City in cash out of its general fund, if able to do so, or from a fund ore-
<br />ated •by a speeml assessment to be levied under the provisions of Section 108 of the above entitled Act.
<br />Assessments of ten 1dollars and -more against: each lot, if deferred, are to be paid in ten equal annual in-
<br />ptallments, ,with interest at the rate of Sig per cent per annum. A bond or bonds will be issued to the con-
<br />tractor to the amount of such deferred assessments in pro rats, payment for such improvement.
<br />Under no circumstances shall the city of South Band be, or be held responsible for any aum or sums due
<br />from sal d property owner or owners for said work, or for the collection of the same, or for the payment of any
<br />bond, bands, certificate or certi'cates, issued to said contractor in payment For such work, except for such
<br />moneys as shall have actually been received by the City from the assessments for such improvement, or such
<br />moneys as said, City is by said entitled' Act and amendment and supplements thereto required to pay. All
<br />proceedings had, and work done in the making of said improvement, assessment of property, collection of as-
<br />$essments and issuance of bonds therefor, shall be as provided for in said above entitled -Act, and Acts amend-
<br />dt0-07 hereof and supplemental thereto.
