<br />STREET OR ALLEY IMPROVEMENT RESOLUTION NO. 615.
<br />BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND,
<br />ST. JOSEPH COUNTY, STATE OF INDIANA, that it is des iced and deeilaedi indcessary to
<br />improve .Huron Street from Meade Street' to the alley east of Koseiuszko Street as follows,
<br />to -wit:
<br />Said Street khall.be graded and the roadway thereof shall be pavedl and
<br />also the roadway -of, cert_ain:_:porti-ons- of the streets -:and alleys which enter or inter-
<br />sect said .stree;t shall, be ,graded and -paved. The _paving material to be used in making
<br />said limprovementshall .be -b itui4inous Macadam, . Concrete-' or Brick, and. -the. -foundation
<br />for toe Brick, pavement sh.all,bd_ rolled gravel not less than six (6) inches thick;
<br />also cement curb shall be constructed, along said street where same isnot already
<br />c onstructod; storm water inlets and -.conduits shall be constructed where necessary; all
<br />manhole tops and storm.water inlets shall be set to the proper grade; cement marginal
<br />curb „shall 1!m constructed at all streets and €llleys .where necessary; . all. -as is more

<br />spec if icat ions; on f il_- in the Office, of the Department of Public Works of- the City of
<br />South Bend, Indiana.
<br />The cost of the lmprovemenf. herein. provided for, anept street and alley Intersections, shall be paid by
<br />4pecial assessment to be levied upon the property specially beneStted, to the amount that the same may be jg6-
<br />ally assessed, therefor, in accordance with an Act of the General Assembly of the State of ludians? ®ntitled
<br />"An Act Concerning Municipal Corporations," approved March 6; 1805, and fit accordance with and pursssat
<br />to the provisions of all acts amendatory and supplemental thereto.
<br />The cost of all street and alley .intersections, including one-half of the width "of the improvement opno-
<br />site street and alleys which run into, but do not 'cross . sald roadway herein proposed to be improved and that
<br />portion of such street or alley abutting upon property belonging to said City, or, upon property not subject to
<br />such .assessment, shall be paid by the City in cash out of its general fund, if able to do so, or from a fund ore-
<br />ated by a special assessment to be levied under the provisions of Section 108 of the above entitled Aet.
<br />Assessments of ten dollars and more against each lot, if deferred, are to be paid in ten equal annual in-
<br />stallments, Tdth interest at the rate of six per cent per annum. A bond or bonds will be issued to the con-
<br />tractor to the amount of such deferred assessments in pro rats, payment for such improvement. —
<br />Vnder no circumstances shah the city of South'Bend be, or be held responsible. for any sum or rums, _d?i9 ,
<br />from said,property owner or owners for said work, or for the collection of the same, or fox the paym-ent cf r r
<br />bond, bonds, certificate or eert?.acates;issued to'said contractor in payment for such work, except. for suca
<br />moneys as shall have actually been received by the City from the assessments for such impravemesTt, or such
<br />moneys as said City is by said entitled Act and amendment and supplements thereto required to pay. ^All
