Clean Air Standards for Workplaces and Public Places Ordinance <br /> Page 13-Substitute Bill No.24-12 <br /> (c) For a business that elects to be exempted under the provisions of Sec. 13-76.6 Exemptions, <br /> it shall be the duty of the owner, manager, or operator to ensure that no persons under the age of <br /> eighteen (18) are allowed to enter. <br /> See. 13-77 Penalties. <br /> (a) Any owner, manager, operator, or other person in control of an establishment, facility, or <br /> outdoor area found to be in violation of any of the provisions of Sec. 13- 76 through Sec. 13-76.10 <br /> shall be issued an ordinance violation citation subject to the following fines: <br /> (1) The issuance of a verbal and written warning for the first violation, <br /> (2) A fine of Two Hundred and 00/100 Dollars ($200.00) for the second violation within the <br /> same calendar year payable through the Ordinance Violations Bureau; <br /> (3) A fine of Four Hundred and 00/100 Dollars ($400.00) for a third violation within the same <br /> calendar year; <br /> (4) A fine of Eight Hundred and 00/100 Dollars ($800.00) for a fourth violation within the <br /> same calendar year; and <br /> (5) A fine of Fifteen Hundred and 00/100 Dollars ($1,500.00) for each additional violation <br /> occurring within the same calendar year. <br /> (b) Each day of violation shall constitute a separate and distinct offense. <br /> Section II. Repeal : Any Ordinance in effect, which is inconsistent, or conflicts with any part <br /> of this Ordinance is expressly repealed to the extent of such inconsistency or conflict, and the <br /> remainder of the Ordinance shall be unaffected and remain in effect. <br /> Section III. Severabilitv: If any section, sentence, or provisions of this Ordinance, or the <br /> application thereof to any person or circumstance shall be declared invalid, such invalidity shall not <br /> affect any of the other sections, sentences, provisions or application of this Ordinance which can be <br /> given effect without the invalid provision or application, and to this end the provisions of this <br /> Ordinance are declared to be severable. <br /> Section 1V. Legal Construction: This Ordinance shall be construed broadly to effectuate the <br /> purposes of this Ordinance. <br /> Section V. Effective Date: This Ordinance shall be in full force and effect beginning July 1, <br /> 2012, after its passage by the Common Council, its approval by the Mayor, and legal publication. <br /> Valerie Schey, 3r District Council Member <br />
