279 <br />Mr. Fred Corporan appeared before the Board and reported that no attention <br />had been given to filling in alley south of Eleventh Street and repairing sidewalk at <br />same place as per contract signed by him with the City in Sept. ,191%. The Board advised <br />Mr. Corporan to get J. W. Vernon in to Board meeting Tuesday August 27th.,1918 at 10:)) <br />A.M. ind have an underatan4ing at that time just what there is to be taken care of. <br />The Board ordered that the gum of Five ($51=00) Dollars per month be <br />paid Wm. Kr seder for house care ;and -the necessary repairs for .Steam Roller at the Central <br />Puipp ing Station. The, -same to be paid out the Street and Alley Dept. , ,funds. , <br />This being the date set for the deferred hearing on plans and specifications <br />on Track Separation under Track Separation Resolution No. 2, it was unanimously resolved <br />by the Board that this matter be deferred until Febrgary 18th.,1919 at 10:00 A.M..Clerk <br />instructed is net ify all parties concerned for said meeting. No interested parties <br />appeared in regard to the above on this date. <br />The following waivers, with resolutions were approved by the Board. <br />TO -THE HONORABLE MAYOR, BOARD OF PUBLIC WORKS AND CONTROLLER <br />OF THE CITY OF SOUTH BEND, IND IANA: -- <br />GENTLEMEN; <br />The undersigned, Chicago, South Bend & Northern Indiana Railway Company <br />desires to take advantage -of the prov is ion of an Act entitled " An Act Concirnin.g <br />Municipal Crporat ions" approved starch 6,1905, and particularly Section 255, and all <br />amendatory and supplemental acts thereto providing for the manner of paying for the paving <br />e$dsforets and alleys in cities and towns, for the issuing and sale of bonds therefor <br />and for the collections of same, and for such purpose hereby expressly waives all objections <br />on account of illegality or irregulabry of the proceedings had for the improvement of <br />by paving of Jefferson Boulevard from Michigan Street to the west and of the bridge <br />over the St: Joseph River in the City of South Bend; Indiana, as designated in Improvement <br />Resolution Number 564 adopted by said City, and request that said City take such action and <br />do such things as may be necessary to entitled the undersigned to take advantage of the <br />provisions of this act, and to include in the amount of the bonds to be issued or sold <br />the ent ire cost of that part of the paving improvement properly chargeable and assessable <br />against said company. <br />CH ICAGO— SOUTH BEND & NORTHERN IND IANA RA MWAY COMPANY, <br />BY S. M. MURDOCK, <br />Secretary. <br />Dated this 19th, day of August 1918. <br />WHEREAS, the City of South Bend, Indiana, by and through its Board of Public <br />Works, heretofore by improvement resolution No. 564. caused Jefferson Boulevard, from <br />Michigan Street to the west and of the bridge over the St. Joseph River, now in the City <br />of South Bend, to be improved by pavng the same; and <br />WHEREAS, the Chicago, South Bend & Northemt Indiana Railway Company occupies <br />a portion of said street for the operation of its electric railway, and by the terms and <br />c and it ions of its franchise is required to pave a portion of said street, and <br />WHMMSm theportion of said street required to be paved by said Railway <br />Company was paved by the Western Construction Company, a corporation of th z� City of <br />Lafayette, County of Tippecanoe and State of Indiana, as contractor for such work, and <br />same was completed by its as such contractor and accepted by the City of South Bend on <br />the 7th.-, day of August 1918; and <br />WHEREAS, the said Railway Company on the day of August ,1918 executed and <br />filed with the said City of South Bend its st ipul at ion add agreement waiving objections <br />on account of any illegality or irregularity in the proceedings had for such improvement <br />of said street and requested the City to issue bonds to procure funds with which to pay <br />that portion of the cost of said improvement chargeable against said railway company in the <br />manner provided by an Act entitled , " An Act Concerning Munc ipal Corporations, " approved <br />March 6th., 1905. and all amendatory and supplemental acts thereto: and <br />
