Version 4-07-2016 CONTRACT AMENDMENT NO. 1 Project: Boland Trail Construction Inspection Services Boland Drive from Portage Avenue to Riverside Drive Des No. 1382758 This Contract Amendment is made and entered into this Contract between the City of South Bend Board of Public Works (hereinafter referred to as "LPA"), and Christopher B. Burke Engineering, LLC (CBBEL) (hereinafter referred to as "CONSULTANT") WHEREAS, the LPA and CONSULTANT did May 23, 2017 enter into a Contract for Construction Inspection Services for the above reference project. WHEREAS, the LPA desires that CONSULTANT extend the Construction Inspection Services to match the new construction schedule. WHEREAS, in order to provide for completion of the work, it is necessary to amend and supplement the contract in the amount of $20,000.00. A Wendx A is amended as follows: Change the Basis of Fee Estimate to include: The construction schedule was delayed due an accidental discovery within the project limits. The construction schedule was amended as follows to address the accidental discovery and subsequent design changes: CBBEL will extend their construction engineering services, including project management and administrative services, to match the new construction schedule. Appendix D is amended as follows.: The CONSULTANT shall receive as payment for work performed under this Contract the total amount not to exceed-1-2"$1unless a supplement is executed by the parties which increases the maximum amount payable. Except as herein modified, changed and amended, all terms of the original contract dated May 23, 2017 shall continue in full force and effect. In Witness Whereof, the CONSULTANT and the LPA have, through duly authorized representatives, entered into this Contract. The parties having read and understand the forgoing terms of this Contract do by their respective signatures dated below hereby agree to the terms thereof.
