<br />V SIDEWALK DIPROVEUENT RESOLUTION NO. 5669
<br />RESOLVED BY -THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND,
<br />ST. JOSEPH COUNTY, STATE OF INDIANA, That it is deemed necessary to improve
<br />the._west one-half,of Ernsperger Street Prom Lincoln Way East to the Bridge over
<br />the St. Joseph River,, as follows, to -wit: -
<br />By grading said street from the property
<br />line to th-- center line of said Ernsperger Street to the established grade, and con-
<br />structing cement sidewalk and cement curb on the west side of said street, all as is
<br />more particularly shown, and all in accordance with the plans, profiles, and detail
<br />drawings on file in the Office of the Department of Public Works of the City of
<br />South Bend, Indiana in accordance with theprofiles , details, drain s and speci-
<br />f ications on file in the office of the ' Department of the Board dr Pubie Works of
<br />said City; and such improvement is now ordered.
<br />The cost of said improvement, including the cost of street and alley
<br />intersections, shall be assessed upon the real estate abutting on said west one-
<br />half of Ernsperger Street all aacording to the method and manner provided for ixr -an
<br />Act pf the General Assembly of the State of Indiana, entitled " Ah Act Concerning
<br />Munie ial Corporations, ' approved March 6,190% and in accordance frith and pursuant
<br />to the ppovidi.ons of all amendatory and supplemental acts theretei ,paksed by the
<br />General asetzhly of the State of Indiana. Assessments, if deferrod; are to be paid
<br />in ten equal annual installments, with interest at the rate of.Si.x per cent per
<br />annum. A bond or bonds shall be issued to the contractor in paymdht Of such work,
<br />unless the property owners pay said assessment before said bond or bonds are issued,
<br />Under no circumstances shall the City of South Bend, be, or be held responsible
<br />for any sum or sums due,.From said property owner or owners for said work or for the
<br />collection of the same, or for the payment of any b=d, bonds, certificate or certl-
<br />f icates, issued to &aid contractor in payment for such work, except for such moneys
<br />as nbail have been actually received by the City from the assssdments for such
<br />Improvement, or such moneys as said City is by said above entitled Act required to .
<br />pay. All proceedings had,and work done in the making of said.improvement, assess-
<br />ment of property, collection of assessments and issuance of bonds therofor, shall
<br />be as provided for in said above entitled -Act and amendments thereto.
<br />Notice of this resolution shall be published on the 27t4. day of
<br />February 1918 add on the 6th. , dlry of starch 1918 in the South Bend Daily Tribune.
<br />This Board will give a hearing ; on this resolution in its fffice in the City Hall on
<br />the 20th. day of March 1918 at 7:45 P.U.
