<br />And t;he'Contractor covenants and agrees with the City,to remove
<br />from the l-9eA.Vion of the C ity Crematory in the C ity of South Bend, or such other
<br />station or stations as may hereafter be agreed lupob by and between the parties, all
<br />garbage and small dead sninals, all in the manner,of and according to the terms
<br />end conditions of the gpectfic it ions now on file in the Office of 6he Board of
<br />Publ is Works,, which spec if lost ions are made a part of 'this contract as, fully
<br />and effectually as if copied herein at full length, and ss d Contractor agrees �o
<br />pay the City at tie.end of each month the sum of One ( 01.90)Dollar per net ton
<br />of 2,000 pounds; all said garbage shall be weighed by the Contractor at the City
<br />Scales located °at the Central Fire Station in said City. Said Contractor agrees
<br />to do and perform said work and buy said garbage and small dead animals from said
<br />City -and to pay; it said price therefor 'from April lat., 1918 to April lat.,, 1928.
<br />The Contractor agrees that in the propebution of said work he
<br />will exercise due and proper skill and care, and will use all proper precaution
<br />to prevent injury to any person or property; and that in the event of any injury
<br />'0 damage resulting from the work or resulting from any matter or thing connected
<br />tkere�ith- or arising therefrom -to any person or property, he will liquidate
<br />ed *ay the same at his own expense and assume the 1 iab it ity therefor; and in the
<br />evexttY of any claim or claims being made or any action being brought against ;the Ciy
<br />City by reason or, account of or growing out of said work, the sadd Contractop will
<br />at his own expense defend the same, and will pay any judgements recovered thereon,
<br />and will in all respects indemnify the City, its officers and &genets, from gll cob
<br />cost, expense , payment or judgement re©overed thereon or in connection with'any
<br />-such Clain or action. And if within 10 days after any action is begun agaia#t.
<br />the City 'it shall notify the' contractor of the pendency thereof, then any ju ge-
<br />meat rendered against the City shall be conclusive against the - Contractor
<br />against the surety an his bond.
<br />And the Centractor agrees to pay for all labor used and
<br />employed by hits in perform%g this contract. And he further agrees hot to assign
<br />sub -let this contract or any,part thereof without the written consent of the
<br />Beard of Public Works first had and obtained.
<br />And the Contractor agrees to do all said work in a sanitary
<br />ifta aer and is accordance with the ordinances of the City relating to the public
<br />tealth and safety and the laws,©i' the State of Indians, all as are now in effect
<br />or may hereafter be adopted or enacted. And he further agrees that said gari age
<br />-and small dead aninals shall at all times be removed in accordance to the
<br />-Instructions of the Board of Publi€ Works, sad that he' and his agents and sesrants
<br />will at all times obey sad comply with the orders and instructions of said Beard
<br />and its authorized agenets. And it is further agreed that said Contractor
<br />will feed said garbage under the supervision sad inspection of a licensed veer-
<br />imariax in good standing, the personnel of whoa shall be pppr®ved by the,Boa#d
<br />of Health of the City, . and such licensed veterinarian shall make a report dr=Shia
<br />Inspection and supervision once each month to both the Board of health and
<br />the Beard of Public Yorks.
<br />And as a part of this agreement the said City agrees that it
<br />will at all times during the life of this contract prohibit ether persons-_fr",
<br />removing garbage from any territory in said City,
<br />And it is agreed that the City by its said Board may deter-
<br />mine for itself the manner of collecting said garbage and aninale, and the extent
<br />of the territory from which it shall collect the same: k'
