Board met in regular session at 10:00 A.M. ,A11 members present. <br />Petition received .read and .laced on file for a light on Talbot <br />Avenue frzm and Howard Street. ` <br />Resolved by unanimous consent of the Board th9t the hearing on <br />the plans, estimates, specifications etc. for ' Track Separation No. 2 of the New York <br />Central Ry. Company tracks in, this City Aould be and is hereby set for hearing on <br />Tuesday November 20th.,1917 at 745 P'M. The Clerk instructed to riotify City Attorney <br />y E F. Seeb in to prepare not ices , for publication and servance on companies andhave <br />same for next session of Board or Tuesday ffetober 30th.`,1917. at 10: 00 A.M. <br />The City Civil Engineer brought up the question to the Board of <br />the protest filed by the White Construction Company in regard to using mortor cushion <br />v under street car tracks on Eddy Street and Mishawaka Avenue. This matter was d1scussed <br />but no action taken. <br />Partial estimate allowed Williston Construction Company Contractors <br />on Howard Street pa;veuiertt improvement between Leeper Avenue and Notre Difi'me Avenue', for the <br />amount of...................................................................$19479.86 <br />The City Civil Engineer filed estimated cost of Portage Avenue <br />Pipe sewer from Alley noilth of Kinyon Street to Stocker -Place st.,..........$1040.00. <br />Excavation bond for the sum of One Thousand Dilars 01,000.00)Dolle.rs <br />signed by Jesse ;Hambay was approved by the Board. <br />The following communication was received from E. F. Seebirt, City <br />Attorney. No action taken on name. <br />October 23rd.1917. <br />Board of Public Works, <br />South Bend, Indiana. <br />Gentlemen: - <br />I have examined the contract a;nd bond in the matter of the construction of the <br />Michigan Street Trunk Sewer under Improvement Resolution No. 367. and it is my opinion <br />that the contractor and surety are liable in damages to the City for any failure to com- <br />plete the contract and perform the work in the* manner stated in the plans and speci- <br />fications. This would include the serer connections as well as any other work covered by the <br />olans and snef is iat ions. <br />Yours very truly, <br />E. F. SEEBIRT. <br />Permission was granted the Central Union Telephone Company to install <br />a three sewer the lateral across Scott Street to enter the Werwinski apa.ratment building <br />in order that we may dismantle the poles on the street as ordered by you. <br />Fermissionalso granted to move the following poles. <br />One pole on the south side of Honroe St. between Main and Michigan <br />Sts. , to be moved -about thirty feet south in the alley; <br />One pole on the north side of South St., between Main and Michigan Streets, <br />to be moved about thirty feet north in the alley. <br />v The Central Union Telephone Company and the South Bend Home Telephone Co., <br />ordered to remove anchor and wire from rear of 901 West Colfax Avenue as same is in way <br />of garage building property owner is about to erect. <br />President. <br />r rC. <br />
