11 <br />Thursday October 18th.,1917. <br />Board met in spec iai session at 5: 00 P.M. Mr., A. H. Rice absent. <br />Mayor F. W. Keller and Mr. ` F. J'. Anderson City Engineer present. <br />A conference was held with Mr. T. G. Grover, Vice Pres. & Gen.11. Mgr. of <br />the Chicago, South Bend & Northern Indiana. Railway Company, Attorney H. A. Wair, Counsel <br />for said Company -and Mr. Southworth of said company, also fir. J. Doyle of the White <br />Construction Company, contractors for pavement improvement on Eddy Street and Mishawaka <br />Avenue, and the matter of hurrying the work on Eddy`Street. and'Mishawaka Avenue was - <br />discussed,, and the Street.Car Company representatives agreed -to co-operate with the <br />White Construction Company repreentative and keep their work ahead of paving gang. <br />Petition received read and placed on file for a pipe sewer on <br />Edst Madison Street from Eddy Street to east and of Madison Street. ;he Board ordered <br />a resolution prepared on same. <br />The following communication received read and placed on file. <br />October 17th.91917. <br />Board of Public Works <br />City of South Bend, <br />Fred F. Anderson <br />Gentlemen: - <br />We have this day received instructions from the City Engineer to lay all <br />brick pavement contemplated under the Improvement Itesolution governing the paving of <br />Eddy Street and Mishawaka Avenue from Jefferson Boulevard to 19th., Street, on a cement <br />grout cushion instead of a sand cushion, which we were preparing to use in the completion <br />of that work. <br />Our intention at the time of filing our bid in the above matter, and our <br />interpretation of our contract in view of our bid and the specifications governing the <br />contract, permitted us to lay the brick in question on sand cushion. We are, however, <br />proceeding to obey the instructions of the City Engineer and hereby desire to notify <br />you that we are doing the same under protest, with the expectation that we will be re- <br />imbursed for the additional cost of the grout cushion. <br />WHITE CONSTRUCTION COMPANY, <br />BY A. WHITE <br />The City Civil Engineer filed following communication, same read and placed <br />on file. <br />October 18th.,1917. <br />Board of Public Works, <br />City ffSouth Bend, Indiana. <br />Gentlemen: - <br />In accordance with _inbtructidna-3 given to me by the Board of Public Works <br />✓ I have instructed the White Construction Company to lay all of the brick pavement to be <br />used on Eddy Street and Iiishawaka Avenue on a, cement grout cushion. <br />The White Construction Company have filed with meths attached protest to the <br />Board of Public Works' interpretation of their bid. <br />I herewith submit their notice of protest for yourconsideration, but shall <br />continue to carry out your original instructions unless I receive other instructions :from <br />you. <br />Yours very truly, <br />FREDERICK J.
