SECOND AMENDMENT TO LEASE BETWEEN <br />SHEIN REALTY AND THE CITY OF SOUTH BEND, AS AGENT FOR THE <br />ATF DISARMED TASKFORCE <br />THIS SECOND AMENDMENT TO LEASE is effective January 1, 2019, by and <br />between Shein Realty LLC ("Landlord") and the City of South Bend, as agent for the ATF <br />Disarmed Taskforce ("Tenant"). <br />WHEREAS, Landlord and Tenant are parties to a certain lease effective January 1, 2017, <br />(the "Lease") affecting that part of the Jefferson Hill Building, Lot 1 Jefferson and Hill Minor <br />subdivision located at 125 S. Hill Street, South Bend, Indiana, 46617, as described in the Lease <br />(the "Premises"); and <br />WHEREAS, the Parties entered into a First Amendment to the Lease which was dated <br />the 12th day of December 2017, (the "First Amendment") and which extended the term of the <br />Lease for an additional One (1) year term, commencing on January 1, 2018 and ending on <br />December 31, 2018 (the "Renewal Term"); and <br />WHEREAS, Landlord and Tenant desire to extend the term of the Lease and to modify <br />the terms of the Lease as hereinafter set forth. <br />NOW, THEREFORE, in consideration of the mutual promises and obligations set forth <br />herein, the parties make this Second Amendment to the Lease as follows: <br />1. Section 1. "TERM" shall be modified to extend the term for a period of one (1) <br />year, commencing January 1, 2019 and ending December 31, 2019. <br />2. Section 3. "Rent" shall be modified as follows: <br />The Tenant shall pay the Landlord as rent, without any setoff or deduction <br />whatsoever, the sum of $10,795.00, payable in one lump sum payment on the first <br />day of February during the term of this Lease. Unpaid rent shall bear interest at <br />the rate of 12% per annum from the date due until paid." <br />3. The Parties acknowledge and agree that except as modified herein, all terms and <br />conditions of the Lease remain in full force and effect. <br />IN WITNESS WHEREOF, the parties have caused this Second Amendment to Lease to <br />be executed for and on their behalf effective the day and year first written above. <br />(Signature Pages Follow) <br />
