AGENDA REVIEW SESSION JANUARY 3, 2019 2 <br />The Agenda Review Session of the Board of Public Works was convened at 10:34 a.m. on <br />January 3, 2019, by Board President Gary A. Gilot, with Board Members Elizabeth Maradik, <br />Therese Dorau, Suzanna Fritzberg, and Laura O'Sullivan present. Also present was Attorney <br />Clara McDaniels. Board of Public Works Clerk, Linda M. Martin, presented the Board with a <br />proposed agenda of items presented by the public and by City'Staff. <br />Board members discussed the following item(s) from the agenda. <br />— Amendment to Professional Services Agreement — DLZ Indiana, LLC <br />Ms. Alicia Czarnecki, Engineering, stated this amendment is for additional archeological studies <br />at Pinhook Park for areas previously undisturbed. She noted they need to determine the path for <br />the trail location <br />- Public Hearing —Resolution No. 01-2019 <br />Attorney Aladean DeRose stated this Resolution addresses Title 6, a part of the Civil Rights Act <br />regarding non-discrimination, and the ADA regarding city accessibility. She noted the City is <br />required to have a Transition Plan, ADA plan, and Title 6 as part of their Federal grant program <br />when Federal funds are used for the purchase of any land. Attorney DeRose noted the City goes <br />beyond the Federal requirements. She stated the plan was originally done in 2013 and passed by <br />the Board of Works, and this is an update to the transition plan now. She noted the progress <br />made in curbs throughout the city and the large reduction in high priority areas near government <br />buildings. She added the plan is ongoing as resources are available with focus on the elimination <br />of any liabilities in high priority areas. She stated the City did a facilities check in city owned <br />buildings in 2015 and found some not up to standards. She added a lot of them were in transition <br />at the time. She stated this plan also covers ADA requirements for the work force, not just <br />facilities. Attorney DeRose noted that Mayor Pete Buttigieg moved the city beyond the Federal <br />requirements in hiring of a diverse workforce. She explained the different aspects of diversity <br />addressed, noting restrictive covenants of any kind are no longer allowed, old or new. She noted <br />the City used to have a lot of them tied to property. When questioned by Mr. Gilot, she <br />confirmed as they apply to minorities, not restrictive covenants in subdivisions. Ms. Dorau asked <br />who her key stake holders that she works with are. Attorney DeRose stated she tries to have <br />those that have a role and voice in these issues and added she is always looking for groups that <br />have a role. Ms. Dorau asked what kind of training is provided if this is adopted by the Board. <br />Ms. DeRose stated she can do the training, adding the document is available in the Public Works <br />office, the City Clerk's office and the Legal office, as well as on the city website. Ms. Fritzberg <br />asked what the schedule is for physical review of buildings. Ms. DeRose stated they should be <br />done every three (3) years, noting there were a lot of influx buildings that weren't able to be <br />done in the city. When questioned about who does the review, she explained there is a staff <br />person at each facility that does the inspection. She noted Mr. Scott Kreeger's presence from <br />Engineering who is working with her on the data, reports, and distribution. Mr. Gilot questioned <br />if the funds aren't available, is it legal to cite someone. Ms. DeRose stated if someone makes a <br />complaint, the city must make accommodations as soon as possible, adding you can make <br />reasonable accommodations also. She noted this plan applies to any event engaging the public as <br />well as facilities. Mr. Gilot noted one (1) instance of accommodating a request for a traffic signal <br />for hearing impaired individuals that the city installed. Mr. Eric Horvath, Public Works Director, <br />clarified they received one (1) grievance for a hearing assistance traffic signal that was <br />addressed, but they've installed more than that. <br />- Project Coordination Contract - INDOT <br />Mr. Scott Kreeger, Engineering, informed the Board the city did a study in 2017, in conjunction <br />with the State, of all the schools in South Bend and found thirty-nine (39) that needed flashing <br />beacons. He stated this is what this contract addresses in coordination with INDOT. He added <br />they are looking at solar panels for an option. <br />PRIVILEGE OF THE FLOOR <br />Ms. Stacey Odum, City Resident, asked the Board how the neighbors in the LaSalle Park area <br />can keep their Cul de Sacs in the vicinity of Chicago St., Lake St., Kentucky St. and Liberty St. <br />vicinity closed. She asked if the neighbors can put a petition together and bring it back to the <br />Board. Mr. Eric Horvath, Public Works Director, stated the city is doing the Western Ave. design <br />to Dundee St. and looking at that area. He introduced Kyle Silveus, the project manager, and <br />suggested she work with him and he could keep her informed of what is going on. <br />No other business came before the Board. Upon a motion by Mr. Gilot, seconded by Ms. <br />Maradik and carried, the meeting adjourned at 11:02 a.m. <br />
