<br />Resolved that notices as to he assessments according to law be published an the
<br />21st., da of September 1917 and on the 28th. day of September 1917 in the South Bend
<br />Daily Tribune, stating that this Board will give,a hearing on the amount of assessments
<br />at its office in the City Hall on the 2nd. day of October 1917 at 7: 45 P.U.
<br />Resolved further, that the entire ,work under thea,bove entract be accepted and
<br />approved and the final estimate thereon allowed, Notice of this resolution shall be
<br />published on the 219t., day of September 1917 and on the 28th. day of September 1917
<br />in the South Bend Daily .Tribune,. ,scat ing that this Board will give a hearing on the
<br />the acceptance of such work 'at -its 'off±ce fn the City Hall on: the grid. day of October 1917
<br />at 7:45 P.M.
<br />It was resolved by -the Board that 'thefe °being no bids received on pipe sewers
<br />on Chestnut Street from -Napier :Street -to -the -Lake Shore Ry.' Company and pipe sewer on
<br />Pleasant Street from Vishawak& Avenue to -River -were under the engineer's estimate, that
<br />the same be advert°ised to bids in the South Bend Daily Tribune, same to be received October
<br />2nd. 1917 at 10:00 A.M. The Board reser v'es the right to reject any and all bids.
<br />Board instructed the White Construction Company contractors for pavement on
<br />Eddy Street and Mishawaka Avenue to remove fence along S. M. Studebaker estate property
<br />it same should be in their way when they were ready to grade said streets, as the said
<br />J. U. Studebaker "estate had been notified to remove same.
<br />Petition received for an electric light at corner of Dayton Street and ]Marine
<br />Street. Same read and placed on file.
<br />The approTing of the Bond - of the White Construction Company was deferred by
<br />the Board until Wednesday September 19th.,1917 at 10:00 A.I. Clerk instructed to notify
<br />Ur. White to be present at said session.
<br />SIDEWALK IMPROVEIVMTT RESOLUTION NO. 558AZ
<br />Resolved by the Board of Pu blic Works of the City of South Bend, St. Joseph
<br />,,-'County, State of Indiana, That it is deemed necessary to improve the north side of Li ncoln
<br />Way West from Olive Street to Fremont Street as follows, to -wit: --
<br />By constructing cement
<br />sidewalk on the noth side of said Lincoln Way Nest from Olive Street to Fremont Street; all
<br />as is more particularly shown, and all -in accordance with the irofiles, plans, detail
<br />drawings and specifications on file in the office of the Department of Public Works of the
<br />City of South Bend, Indiana, in accordance with the profiles, details, drawings and
<br />specifications on file in the oftdes of the Department of the Board of Public Works of said
<br />City; and such improvement is now ordered.
<br />The cost of said improvement, including the cost of strut and alley inter-
<br />sections , shall be assessed upon the real estate abutting on said Lincoln Way hest ill
<br />according to the method and manner provided for in an Act of the General Assembly of the
<br />State of Indiana, entitled " An Act Concerning Municipal Corporations, " approved March
<br />6,1905, and in accordance with and pursuant to the provisions of all amendatory and=supple-
<br />mental acts thereto, passed by the General Assembly of the State of Indiana. Assessments,
<br />if deferred, are to be paid in ten equal annual installments, with interest at the rate
<br />of six per cent per annum. A bond or bonds shall be Ingygd Jorghe contracto r in payment
<br />of such work, unless the property owners pay Saud assessment before said bond or bonds are
<br />issued. Under no circumstances shall the City of south Bend, be or be held responsible
<br />for any sum or sums due from said property owner or owners for said work or for the collecti
<br />of the same, or for the payment doe of any bond, bonds, certificates or certificates,
<br />issed to said contractor in payment for such work, except for such mneys as shall have
<br />been actually received vy the City fromthe assessments for such improvement, or such
<br />moneys as said City is by said above entitled Act required to pay. All proceedings had, and
<br />work done in the making of said improvement, assessment of property, colle ction of assess-
<br />ments and issuance of bonds therefor, shall be as provided for in said above entitled
<br />Act and amendments thereto.
<br />Notice of this resolution shall be publislmdd or. the 19th. day of September
<br />1917 and on the 25th. day of September 1917 in the South Bend Daily Tribune, This Board
<br />will give a hearing on this resolution in its office in the City Hall on the 2nd. day of
<br />October 1017 at 7:45 P.U.
