Board met in special session at 11:00 A.M. All members present. <br />On June i9th. , 1917 the W. B. Br ady Construction Company appearA <br />before the Board and requested to be released from its contract fo-e the construction <br />of the pavement on Eddy Street and Mishiawaka Avenue from Jefferson Blvd. to Nineteenth <br />Street under Improvement Resolutton No. 411. and "the time for the decision' d,f the <br />matter was -continued until Thursday June 21st ,1917 at 11:00 A.U. and continued' <br />from Thursday June 2lst.,.191'7 until this day. There were present all members of the <br />Board, the City Attorney, Eli. F. Seebirt, City Engineer F. J. Anderson, certain <br />property owners living on said streets and their9 Attorney F. E. Lambert, F. I. Hardy <br />Gen'1. Ugr. of the Chicago, South Bend-`& Northern Indiana Railway Company, W. B.' Brady <br />President of the W. Bi Brady Construction Company and M. M. Townley; Attorney for the <br />W. .B..Brady Construction Company• <br />And ;the Board announced and stat*A that they would expect the Brady <br />Construction Company topprform its contract aid ti dt they would give, & -reasonable <br />time for the completion of thw work, but that the work should be commenced at once. <br />And there upon Mr. W. B. Brady and Mr. Townley, President and Attorney <br />respectively of said Brady Construction Co., stated said company positively would not <br />perform its said contract and -that the Board was at liberty to let contracts or`contract <br />for the doing of said work and paving said streets to any other person or persons. <br />And the Bo:aid thereupon informed said W. B. Brady Construction Company <br />through and byits said President and Attorney that said Company would be expected <br />and required to pay the City any additional amount of test for- making said improvement <br />over and above the amount `'for which .said Co*r.-Pr71 :i �,d, ry }red in its Trit- nr� -oo `rn: ct <br />to make ,said improvement for. The Board therefore by u- animous consent adopted three . <br />resolutions -for the pavement of Eddy Street and Mishawaka Avenue.dividing th4 distances <br />as equally as possible, <br />STREET 0R ALLEY I14P 0VEMENT RESOLUTION NO.'5�9 <br />Be It Resolved by the .Board of Public Works of the City of South <br />Bend, St. Joseph. County, Stateof Indiana, that itha it is desired andli deemed necessary <br />to improve Eddy Street from Jefferson Blvd. to the south line of Mishawaka Avenue as <br />f ollows, to -wit: - - - <br />Said Street shall be graded, and the roadway thereof shall be paved_; and <br />als the roadway of certain portions of the streets and alleys which enter or intersect <br />said street shall be graded and paved. The paving material to be used in making said <br />improvement shall b Sheet Asphalt, Bitiltihic, Asphaltic concrete or Brick, -and the <br />foundation shall be portland cement concrete, five (5) inches thick for the sheet aspitt, <br />bitulithic, asphaltic concrete and brick or rolled gravel six (6) inches thick for <br />brick. also cement curb shall be constructed along said street where same is not already <br />constructed; storm water inlets and conduits shall be constructed where necessary; all <br />manholes, covers and storm water inlets shall be set to the proper grade and cement <br />marginal curoshall be constructed at all streets and alleys where necessary; all as is more <br />particularly -shown, and in accord me with the profiles, plans, detail drawings and speci- <br />fications n file in the office' of the Department of Public Works of the City of South <br />Bend, Indiana. <br />The cost of the improvement herein provided for, except street and <br />alley intersections shall be paid by special assessments, to be levied upon the property <br />specially benefitted, to the amounts that the same may be legally assessed therefor <br />in accordance with an Act of the General Assembly of the State of Indiana, entitled <br />" An Act Concerning Municipal Corporations, " approved March 6,1905, and in accordance <br />with and pursuant to the provisions of all acts amendatory and supplemental thereto. <br />The cost of all street and alley intersections, including one-half of the <br />width of the improvement oposite street and alleys which run into, but do not cross said <br />roadway herein proposed to be improved and that portion of such street or alley abutting <br />upon property belonging to the said City, or upon property not subject to such assess- <br />ment, shall be paid by the City in cash out of its general fund, if able to do so, or from <br />a fund created by a special assessment to be levied under the provisions of Section 108 of <br />the above entitled Act. <br />and more against each lot, are to be paid in t <br />at the rate of Si per cent per annum.
