63� SIDEWALK IMPROVE1,1ENT RESOLUTION NO. 534. Resolved by the Board of Public Works of the C ity ' of South Bend,., St. abseph County. State of Indiana, That it is deemed. necessary `to improve Seventeenth Street from Mishawaka Avenue..to the Grand Trunk Western Ry. Company as follows, to -wit: - By grading said street from property line to property line to theestablished grade, curbing the roadway with cement curb and con- structing cement,sidewalk op both sides of said Seveneteenth Street...All as shown on the plans and in accordance with the profiles and detail drawings and speef icat ions on file in the office of the Department of Public Works of the City of South Bend, Indiana) in accordance with the profile, details and drawings and specifications on file Fn the office of -the Department of Public Works of said City; and such improvement is now ordered: The cost of said improvement, including the cost of street and alley intersections, shall be assessed upon the real estate abuttng on said leventeenth Street all according tothe method and ammner provided for in an Act of the General Assembly of the State of Indiana, entitled an Act Concerning. Municipal Corporations, approved March 6,1905, anal Iin a ccordance with and pursuant to the provisions of 611 amendatory and supplmental acts thereto, passed by the General Assembly of the State of Indiana. Assessments, if deferred are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in payment of such work, unless the property owners nay said assessment before said bond or bonds are issued. Under no circumstances shall the City of South Bend, be or be held responsible for any sum of sums due -from said property owner or owners for said work, or for the collection of the same, or for the payment of any bond, bonds, certificate or certificates, issued to said contractor in payment for. such improvement, arr such moneys, as said City is by said above entitled Act required to pay. All proceedings had, and work done in the making of said improvement, assessments of property, .collection of assessments, afld issuance of bonds therefor, shall beas provided for in said above eneitlted Act and amendm6nts thereto. Notice of this resolution shall be published on the 14th. day of June 1917 and on the 21st. day of June 1917 in the South Bend Daily Tribune. This Board will give a hearing on this resolution in its office in the City Hall on the 3rd . day of July 1917 at 7:45 P.M. Adopted this 12th. day of June 1917. E. M. MORRIS A. H. Fuchs did purchase from the City of South Bend, Indiana, for the consideration of Twenty (020.00)Dollars the following described property: - All of lot 714 Third Addition in the City Cemetery of the City of South Bend, Indiana. WHEREAS, said John F. Fuchs sole owner or the above described property having lost the deed for said lot now,. THEREFORE, BE IT RESOLVED, By the Board of Public Works of said City, that the Mayor of said City be and is hereby instructed to issue a duplicate deed to said John F.
