SAID IMPROVEMENT SHALL BE KNOWN AS PORTAGE TRUNK SEWER, Under Improvement Resolution No. 502. In the City of South Bend, Indiana. Under ncr cfrc'umstances shall the City of South Bend be or be held re- sponsible for any sum or sums due from said property owner or owners° for said work; or for the collection of the -same., or for the payment bf any bond, bonds, certificate or certificates issued to said contractor in payment for such work, except for such moneys as shall have been actually received by said City from the assessments for such -improve- ments. All proceedings had and work ,done; in the construction of said main sewer, and its qDppurtenances, manner of assessment of property collection of assessment and issuance of bonds therefor, shall be as provided for in an Act of the General Assembly of the State of Indiana, entitled " An Act Concerning Municipal Corporations," in matters pertain$n.g to the construction and alteration and maintenance of public .drains and sewers, prov id ing for the construction, alteration and maintenance of such sewers and drains in such cities and within four miles thereof, also providiing for the assessment of property specially benef fitted thereby for the payment thereof, in whole or in part, and for the collection of such assessments; repealing all laws and parts of laws in con- flict therewith, and declaring an emergency , approved March 6,1905 and all acts'supple- mentary and amendatory thereto,'passed by the General Assembly of -the State of Indiana. Notice of this resolution shall be published on the 30th. day of March 1917 and on the 6th. day of April _1917 in the South Bend Daily Tr ibune. ' This. JOSEPH, STATE OF INDIANA: That it 'is desired and deemed necessary to construct a sewer in High Street, Ewing Avenue, Miami Street Donald Street, Fox Street, Altgeld Street, Victoria Street and the alley west of Dale Avenue all in said City, which, from its -size and character, is not only intended and adapted for use by property owners whose property abuts along the line of said sewer, but is also intended and adapted for re- ceiving sewage from so•llateral drains already constructed or which may be hereafter con- structed, and the same is hereby ordered constructed in and along the following line of said City , to -wit:- Beginning at.the intersection of High Street and Bowman Street; thence south on the center line of High Street to the center of Ewing Avenue with a 33 $nch circular sewer; thence east on the center line of Ewing Avenue to the center of the first alley -west of Dale Avenue with a 33 inch circular sewer; thence still east on the center line of Ewing Avenue to the center line of Miami Street with a 22 inch circular sewer; thence south along the cefiter line of Miami Street to the center of Altgeld Street with a 15 inch .vitrified pipe sewer; thence still south along the center of Miami Street to the center of Fairview Avenue with a •12 inch vitrified pipe sewer; thence still south along the center of Miami Street to the south City Limits with a 15--inch vitri- f ied . pipe sewers Also; Beginning at the intersection Of the center line of High Street and Donald Street thence east along the center line of Donald Street to the center of Dale Avenue with a 12 inch vitrified pipe sewer. Also, beginning at the intersection of the center line of High Street and Fox Street; thence east along the center line of Fox Street to the center of Dale Avenue with a 12 inch vitrified pipe sewer. Also begin- ning at the intersection of the center line of Altgeld Street and the first alley west of. Dale Avenue; thence east along the center of Altgeld Street.to a point 100 feet west of the west 1 ine of Miami Street with a 12 inch vitrified pipe sewer; Also beginning at the intersection of the center line of Altgeld Street , alid the first -alley west of Dale Avenue, thence west along the center line of Altgeld Street to the center of High Street with a 15 inch vitrified pipe sewer thence still west along the center of Altgeld Street to the west line of Chas; Weidler's Addition with a 12 inch vitrified pipe sewer.Also; beginning at the intersection of the center line of Victoria Street and the first alley west of Dale Avenue; thence east along -the center of Victoria Street to a point 100 feet west of the west 1 ine of Miami Street with a 12 inch v itr if ied pipe sewer.
