EJCDC..=!`. <br />ENGINEERS JOINT CONTRACT <br />DOCUMENTS COMMITTEE <br />AGREEMENT <br />BETWEEN OWNER AND ENGINEER <br />FOR <br />PROFESSIONAL SERVICES <br />THIS IS AN AGREEMENT effective as of December 6 h, 2018 ("Effective Date") between <br />Board of Plublic WorjC , City ty cr4"' of ik l ei d, l.Ia l lz ("Owner") and <br />EmNet, a Xylem brand ("Engineer"). <br />Owner's Project, of which Engineer's services under this Agreement are a part, is generally identified as <br />follows: <br />118-109: 2018 CSO Reduction Project ("Project"). <br />Engineer's Services under this Agreement are generally identified as follows: <br />Since the commissioning of the real time monitoring component of South Bend's smart sewer in 2008, the <br />City has made a series of improvements to their RT-DSS (real time decision support system) in a continued <br />effort to reduce CSO overflows and improve water quality in the St. Joseph River. The City has continued <br />to enhance the Real Time Control to further reduce CSO discharges, provide support to operations and <br />maintenance, and aid with compliance requirements. EmNet has continued to explore where additional, <br />minimally invasive work could be performed to provide additional capacity and throughput to continue the <br />overflow mitigation effort, alongside other tasks that will enhance prediction and control accuracy. The <br />system has begun making deep impacts on the overall cost of the Long Term Control Plan (LTCP). Further <br />strategic work affords the opportunity to continue to significantly reduce overflow volumes, and <br />demonstrate to the federal and state level regulatory powers that be, that the City is making continued <br />efforts to mitigate LSO's. <br />Owner and Engineer further agree as follows:. <br />1.01 Basic Agreement and Period of Service <br />A. Engineer shall provide, or cause to be provided, the services set forth in this Agreement. If <br />authorized by Owner, or if required because of changes in the Project, Engineer shall furnish <br />services in addition to those set forth above.
