The term "illegal drugs" does not mean the use of a controlled substance pursuant to a valid <br />prescription or other uses authorized by law. <br />Iwaqutive Ta t - A negative screening obtained if: (1) the screen test indicated the absence of <br />legal or illegal substances in excess of the screen limit, or (2) the screen test indicates the <br />presence of legal or illegal substances in excess of the screen limit but the confirming test <br />indicates the absence of legal or illegal substances in excess of the confirmation limits. <br />PANPANg Teal..- A positive test result is obtained if: (1) substance abuse test results indicated <br />the presence of illegal substances in excess of both the screen and confirmation limits, as <br />verified by a Medical Review Officer, and (2) the Medical Review Officer has determined that <br />the test results do not stem from the use of prescriptions medicines, over-the-counter <br />medicines, food, or any cause than the use of illegal substances. <br />Probablg QaijAe - Probable cause will be defined as those circumstances, based on objective <br />evidence about the worker's conduct in the workplace that would cause a reasonable person <br />to believe that the worker is demonstrating signs of impairment due to alcohol or other drugs. <br />In most cases, the objective evidence giving rise to probable cause will be observed by at <br />least two individuals, but recognizing that in certain circumstances the observation may be <br />made by only one individual. Examples of objective evidence include when a worker shows <br />signs of impairment such as difficulty in maintaining balance, slurred speech or erratic or <br />atypical behavior. <br />Working Hours - Includes the entire period of normal working hours, including lunch periods <br />and break periods. <br />Procedures <br />Prohibited Activities <br />Employees are prohibited from manufacturing, possessing, using, selling, distributing, <br />receiving or transporting any controlled substance or illegal drug. <br />Employees are prohibited from performing duties or operating heavy machinery while <br />under the influence of alcohol or control ledAl legal substances or drugs. <br />Testing Requirements <br />01 Pre -Employment Screening Policy <br />o Al applicants who are being considered for employment will be required to <br />submit to a drug and alcohol screen. If the applicant refuses to consent or tests <br />positive, the applicant will not be allowed to report for work. <br />For Cause Test <br />o If an employee is reasonably suspected of possessing, distributing or selling <br />drugs or alcohol on G.E. Marshall, Inc. property or jobsite at any time. <br />o If the employee's behavior or job performance is reasonable cause to suspect <br />that he/she is under the influence of drugs or alcohol on the job. <br />o Employee is unable to perform work in a safe or productive manner. <br />o Reasonable suspicion will be determined by a company official or competent <br />person. <br />0 2016 Safety Management Group of IN, Inc. 160 <br />
