The following information is provided on a "to the best of our <br />knowledge" basis for the past five years. At any given time, in the ordinary course of national business, Insituform is <br />involved in various civil claims and suits relating to vehicle accidents, other property damage or personal injury <br />matters, commercial disputes (including subcontractor disputes and customer payment disputes), employee litigation <br />and other matters. Insituform's parent company, Aegion, which is publicly traded is required to report material <br />litigation involving Insituform in its SEC filings. If the City has specific requests, Insituform will do its best to provide <br />supplemental information. <br />(a) Deowdhat, et al. v. Insituform Technologies, Inc., et al., 2011. Superior Court of New Jersey, Morris <br />County. MRS-2978-11. Plaintiff alleges property damage arising out of backup of sewer laterals. Tort <br />claim. Amounts are not liquidated. Claims are also made against Owner by residents. Settled. <br />(b) Moseley, et al. v. Metra, Inc., et al. 2016. Circuit Court of Maryland for Baltimore City. Case No. 24-C- <br />16-003332. Plaintiff claims that subcontractor of Insituform failed to properly connect service connection <br />which resulted in property damage. Tort claim. Owner was a co-defendant. Amounts are not liquidated. <br />Settled. <br />(c) People's Trust Insurance Company v. Proline Vactor Services, Inc., et al. 2016. Circuit Court of the 1811` <br />Judicial Circuit in and for Brevard County, Florida. Case No. 05-2016-CA-050060. Plaintiff claims <br />property damage from a backup through a service connection. Owner is a co-defendant Tort claim. <br />Amounts are not liquidated. Settled. <br />(d) MAYOR AND CITY COUNCIL OF BALTIMORE, Plaintiff, v. INSITUFORM TECHNOLOGIES, <br />LLC, Defendant. 2015. DISTRICT COURT OF MARYLAND FOR BALTIMORE CITY, Case No.: <br />0101-0026227-2015, Case No.: 0101-0025623-2015, Case No.: 0101-0025641-2015, Case No.: 0101- <br />0026441-2015, and Case No.: 0101-00279822-2015. Plaintiff claims Insituform is liable for fines related <br />to delayed street repairs. Dismissed with prejudice. <br />(e) SHANNON STEWART, KYLA HAMLIN, INDIVIDUALLY AND AS GUARDIAN AD LITEM FOR <br />IVAN STEWART, Plaintiffs, v. INSITUFORM TECHNOLOGIES INC. STEWART ENGINEERING <br />AND CALIFORNIA DEPARTMENT OF TRANSPORTATION, Defendants. SUPERIOR COURT OF <br />THE STATE OF CALIFORNIA, COUNTY OF NEVADA. 2014. Case No. CU14-080204. Plaintiffs <br />allege personal injuries from exposure to styrene. Owner was a co-defendant. Dismissed with prejudice. <br />(f) City of Atlanta v. Insituform Technologies, LLC, Superior Court of Fulton County, Georgia. 2011. Case <br />No. 2011CV204217. Plaintiff City alleged defective work and late completion. Defendant Insituform <br />counterclaimed for payments due. Dismissed with prejudice. <br />(g) Insituform Technologies, LLC v. Metals & Materials Engineers, LLC. 2016. Superior Court of Fulton <br />County, Georgia. Case No. 01-16-0003-7598. Plaintiff Insituform claims amounts owed on a project for <br />City of East Point, GA. Settled. <br />(h) Insituform Technologies, LLC v. City of Deer Lodge. 2017. Montana. Plaintiff Insituform is owed <br />retainage, trade and claims for delay. Settled. <br />
