5. Data collected will be posted to the macoggis.com website. 6. MACOG further agrees to complete up to twenty (20) 12-hour turning movement counts. MACOG will annually provide the TTAC with a list of congested roads, however, the City of South Bend Board of Public Works is responsible for identifying the intersections to be studied in writing to the MACOG Director. 7. MACOG, in partnership with the City of South Bend and other communities, will develop an Active Transportation program. MACOG will employ an Active Transportation Planner to serve as a liaison for bicyclists and pedestrians in the region, provide technical assistance, and works toward improving infrastructure, programs, and services that are available to cyclists and pedestrians. As part of the program, MACOG will work with the City of South Bend, and other participating communities, to identify locations to conduct bicycle and/or pedestrian counts. Under this MOU, the City of South Bend Board of Public Works agrees to provide the MACOG $28,000 which may be used by the MACOG as local technical assistance and planning, matching funds. These funds will be paid to the MACOG within 30 days of the effective date (July 1, 2018) of this agreement. 9. This memorandum of understanding may be declared null and void if: A. Either party fails to abide by the intent of this Memorandum of Understanding or; B. Both parties mutually agree to end this data partnering. 10. The effective dates for this Memorandum of Understanding will be July 1, 2018 through June 30, 2019 with provision for annual renewal.
