— Public Responsibilities —buildings or facilities where the public pays fees or municipal <br /> services, obtains permits and licenses, obtains information about public matters, obtains <br /> public services <br /> — Special Programs—buildings or facilities where special programs for the public take place <br /> and cannot be duplicated elsewhere. These include park facilities such as the zoo, golf <br /> courses, swimming pools, splash pads, museums, entertainment facilities <br /> — Geographic Need—buildings or facilities located within neighborhoods or away from City <br /> center which serve the local citizens in some manner <br /> — Sites of Complaint—buildings or facilities where disabled persons have made specific <br /> complaints about inaccessibility <br /> IMPLEMENTATION SCHEDULE <br /> Consistent with the City's 2013 Transition Plan for pedestrian facilities in the public right <br /> of way, the Schedule for ADA accessibility improvement of existing public buildings and facilities <br /> for services, programs,and activities will take place as opportunity and funding allow, with every <br /> effort being made to do so as promptly and expeditiously as is reasonable, taking into account <br /> prioritization described in the previous Section. The City's Public Works Director or City Engineer <br /> will review the ADA accessibility priorities annually; will give high weight to reasonable <br /> suggestions and needs expressed by disabled persons or representatives of disabled persons,and <br /> by the City's ADA/Title VI Coordinator; will consider information received through ADA <br /> grievances; and will make recommendations to the Common Council for funding of these ADA <br /> accessibility priorities. <br /> A design plan calls for upgrading public park restroom facilities so that all will be fully ADA <br /> complaint by December 2019. The playground equipment in Keller Park is all new and ADA <br /> compliant. Similar upgrades are planned in all other City public parks having playground <br /> equipment. The Charles Martin Center has been fully upgraded and all its facilities are ADA <br /> compliant. <br /> NEW CONSTRUCTION AND ALTERATION <br /> For any new construction project or alteration of an existing public building or facility as <br /> the term "alteration" is defined by law, the City will build or rebuild to prevailing ADA design <br /> guidelines. However, the ADA does not require the City of South Bend to take any action that <br /> would cause a fundamental alteration in the intent of its program or activity; that would create <br /> Page 17 <br />
