R -Iu T .2s The Company will conduct a return -to -duty test prior to an employee <br />returning to safety -sensitive duty following a DOT violation. When an employee has a DOT violation <br />the employee cannot work again in any DOT safety -sensitive function until successfully completing <br />the Substance Abuse Professional (SAP) return -to -duty requirements, Only after the SAP has <br />reported to the Company that the employee Is eligible to return to safety -sensitive duties is the <br />Company authorized to return the employee to a covered function. How r whether or not to do so <br />is a gusiness decision of the Company, not the DOT. When the Company makes the decision to <br />return the employee to safety -sensitive duty, the Company will initiate the order for the retum-to-duty <br />test. All retum-to-duty tests will be conducted using direct -observation collection procedures. <br />A retum-to-duty test, as a minimum, will be for the substance associated with the violation. A return - <br />to -duty test may, however, be lbr both drugs and alcohol, The decision belongs solely to the SAP <br />from information gained during the SAP-evaluation/treatment processes. The results of a return -to - <br />duty drug test must be negative in order "to count" and allow the employee to return to work. A <br />cancelled test must be recollected; a positive test or refusal -to -test will be considered as a new, <br />separate violation. When the employee "passes" his retum-to-duty test, their name is immediately <br />placed into the Company's random testing pool. <br />26 <br />after anemployee returns to safe psensitive work, following a negative result es of tests that occur <br />F liow-u Testing, The Company will conduct follow-up testing, as a series <br />"~ g g on the return -to -duty,.. <br />drug and/or alcohol tests. Follow-up testing, as a minimum, will be for the substance associated with <br />the violation. In addltion, follow-up testing may be for both drugs and alcohol, as directed by the <br />SAP's written follow-up testing plan. <br />Follow-up testing is the Company's responsibility to conduct. Follow -rap testing will run concurrently <br />with random testing. All follow-up tests will be conducted using direct -observation collection <br />procedures. <br />The number and frequency of the follow-up tests will be determined by the SAP, but shall consist of <br />at least six tests in the first 12 months following the covered employee's return to duty. The follow-up <br />plan will give both the number of tests and their frequency; the Company will select the actual day <br />and time of the test and the tests are unannounced. Follow-up testing shall not exceed 60 months <br />from the date of the covered employee's return to duty. The SAP may terminate the requirement for <br />follow-up testing at any time after the first six tests have been administered, if the SAP determines <br />that such testing is no longer necessary. <br />2. Drug Tests That Require Direct Observation Procedures <br />Compliance. The Company will conduct all retum-to-duty and follow-up drug tests using the direct <br />observation collection procedures specified by Part 40. Pre -employment, post -accident, reasonable <br />suspicionloause and random drug tests are norm -ally conducted by giving the employee the privilege <br />of privacy when providing the urine specimen. However, should it become required that these <br />collections be conducted under direct observation procedures, the Company will convey instructions <br />to the collector to ensure that this is done. Direct observation procedures will also be used for <br />collections when a specimen is provided and the temperature is out of range, when the specimen <br />appears to have been tampered with or when a previous specimen has been reported as invalid, <br />adulterated, substituted or negative -dilute with a creatinine concentration greater than or equal to 2 <br />mg/dL but less than or equal to 5 mg/dL, as defined in Part 40. <br />J.
