percentage determined by addendum of the appropriate hourly rate of pay. Stockpiles under this section <br />may not be placed adjacent to the work site (road beds, ramps, dikes, situ of construction, etc.). This <br />does not include the movement of materials within the job site, materials dumped directly on the road bed <br />or site of construction and spread, nor does it include delivery of hot mix asphalt or concrete paving <br />materials or materials dumped into any type of spreading machine on the job site. <br />(b) Residential Construction Work, <br />Wage rates for delivering aggregate fill material from off of the job site to a job site and for hauling <br />excavated material from a master stockpile on a job site off of the job site shall be at 80% of the <br />appropriate hourly rate of pay. This does not include the movement of materials within the job site, nor <br />does it include delivery of hot mix asphalt or concrete paving materials or materials dumped into any tpe <br />of spreading machine on the job site, <br />(c) Work Assignment. <br />When performing work at a reduced rate, as provided for in Sections 6(a) and 6(b) above, all such <br />reduced rate work shall only be performed by Teamsters Local No, 142 members in good standing. <br />(d) Offsite Plants and Yards. <br />This entire Section 6 shall not apply to offsite plants and yards. <br />(e) Duration. <br />This entire Section 6 shall remain in effect so long as similar language exists in the NWI Contractors <br />Association agreement with Teamsters Local No. 142 (NWI Agreement) — currently Article 11, Section 7 <br />within the NWI Agreement. Should all similar language be eliminated from the NWI Agreement in a future <br />negotiation, then this Section 6 shall be terminated upon the same effective date of the new NWI <br />Agreement that no longer contains similar language. <br />Section 7. Drivers shall be limited to making three (3) equipment changes per day. However, the <br />following shall not be considered equipment changes: <br />(a) Buses. <br />(b) Service Trucks working out of a service pool delivering material and equipment to job sites. <br />(c) Breakdowns. <br />(d) Starting a new job during tour of duty which necessitates change of equipment. <br />Section 8. This Section is applicable to two (2) types of Hazardousfroxic Waste Material <br />Handling, Removal and/or Disposal work: <br />1-(a) A Hazardous/Toxic Waste Project that is specifically bid as a project involving the handling, <br />removal and disposal of Level A, B, C or D Hazardous/Toxic Waste Materials as defined by the <br />United States Environmental Protection Agency and which is designated by that agency as a <br />Hazardous/Toxic Waste removal site at the time of bid. <br />1-(b) The handling, removal and/or disposal of Hazardous/Toxic Waste where the following conditions <br />are met; (1) unexpected Hazardous/Toxic Waste Materials as defined in Section 8, Item (a) above <br />are encountered; (2) the handling, removal and disposal of Hazardous/Toxic Material that <br />constitutes an item of work not specified in the construction contract; and (3) the location of <br />Hazardous/Toxic Waste that becomes designated as a Hazardous/Toxic Waste removal site by <br />the Environmental Protection Agency after the bid. <br />When employees are required to work with Hazardous/Toxic Waste Materials classified as Levels <br />A, B. C or D on a Hazardous/Toxic Waste Materials Removal project as defined in Section 8, <br />Items 1-(a) or 1-(b) above, the following conditions shall apply. <br />2-(a) The removal of Hazardous/Toxic Waste Materials will be subject to any and all safety regulations <br />and insurance provisions that may be required by the appropriate governmental agencies. <br />13 <br />
