ORDINANCE NO . 1 ~ ~ ^'~ O~ <br />AN ORDINANCE AMENDING THE ZONING ORDINANCE <br />FOR PROPERTY LOCATED IN THE 2100 BLOCK OF EDISON ROAD & OAK PARK DRIVE AND <br />1345 & 1357 NORTH IRONWOOD DRIVE, SOUTH BEND, INDIANA 46615, COUNCILMANIC <br />DISTRICT NO. 4, IN THE CITY OF SOUTH BEND, INDIANA <br />STATEMENT OF PURPOSE AND INTENT <br />THE PROPERTY LOCATED IN THE 2100 BLOCK OF OAK PARK DRIVE IS PRESENTLY ZONED <br />"SF1" SINGLE FAMILY AND TWO FAMILY DISTRICT AND CONTAINS A PARKING LOT. THE <br />REMAINING PROPERTIES LOCATED IN THE 2100 BLOCK OF EDISON ROAD AND AT 1345 AND <br />1357 NORTH IRONWOOD DRIVE CONTAIN A RETAIL CENTER AND PARKING LOTS AND ARE <br />PRESENTLY ZONED "LB" LOCAL BUSINESS DISTRICT. ALL THE PROPERTIES ARE REQUESTED <br />TO BE REZONED TO THE "CB" COMMUNITY BUSINESS DISTRICT TO ALLOW FOR THE <br />CONSTRUCTION OF A PHARMACY WITH A DRIVE-THRU WINDOW. <br />NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA: <br />SECTION I. ORDINANCE NO. 9495-04, IS AMENDED, WHICH ORDINANCE IS COMMONLY <br />KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA, BE AND THE <br />SAME HEREBY IS AMENDED IN ORDER THAT THE ZONING CLASSIFICATION OF THE FOLLOWING <br />DESCRIBED REAL ESTATE IN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, STATE OF <br />INDIANA: <br />THAT PART OF THE NORTHEAST QUARTER OF SECTION 6, TOWNSHIP 37 NORTH, RANGE 3 <br />EAST, PORTAGE TOWNSHIP, CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA WHICH IS <br />DESCRIBED AS: LOTS NUMBERED THREE (3), FOUR (4), FIVE (5) AND SIXTY NINE (69) AS <br />SHOWN ON THE PLAT OF "WOODED ESTATES" AS RECORDED IN THE RECORDS IN THE OFFICE <br />OF THE RECORDER OF ST. JOSEPH COUNTY, INDIANA, IN PLAT BOOK 16, PAGE "W", NOW <br />WITHIN AND A PART OF THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, INDIANA. <br />TOGETHER WITH THE EAST HALF OF THE VACATED ALLEY LYING WEST ADJOINING SAID LOTS <br />3, 4, 5, AND THE WEST HALF OF THE VACATED ALLEY LYING EAST AND ADJOINING TO SAID <br />LOT NUMBERED 69 AND THE SOUTH HALF OF THE SOUTH HALF OF THE VACATED ALLEY LYING <br />NORTH AND ADJOINING SAID LOT 69 AND THE FOLLOWING PORTION OF THE VACATED ALLEY <br />DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHEAST CORNER OF SAID LOT 69, THENCE <br />NORTH 10 FEET, THENCE EAST 10 FEET; THENCE SOUTH 10 FEET, THENCE WEST 10 FEET TO <br />THE PLACE OF BEGINNING. <br />ALSO INCLUDING LOTS NUMBERED SIX (6), SEVEN (7) AND EIGHT (8) IN SAID "WOODED <br />ESTATES" SUBDIVISION, TOGETHER WITH THAT PORTION OF THE VACATED NORTH-SOUTH <br />ALLEY LYING BETWEEN LOTS SIX (6) AND SEVEN (7) ON THE EAST LOT EIGHT (8) ON THE <br />WEST AND TOGETHER WITH THE NORTH HALF OF THE VACATED EAST-WEST ALLEY LYING SOUTH <br />OF LOT EIGHT (8). <br />CONTAINING 1.52 ACRES MORE OR LESS. <br />SUBJECT TO ALL LEGAL HIGHWAYS, EASEMENTS AND RESTRICTIONS OF RECORD. <br />BE AND THE SAME HEREBY ESTABLISHED AS "CB" COMMUNITY BUSINESS DISTRICT. <br />
