RESOLUTION NO. 816
<br />RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION
<br />CONFIRMING RESOLUTION NO. 809, REDECLARING THE STUDEBAKER
<br />CORRIDOR DEVELOPMENT AREA TO BE BLIGHTED AND AMENDING TAX
<br />ALLOCATION PROVISIONS THEREIN.
<br />WHEREAS, the South Bend Redevelopment Commission
<br />. Commission governing body of the City of South Bend
<br />� Department of Redevelopment (Department), on August 28, 1987,
<br />adopted Resolution No. 809, redeclaring the Studebaker
<br />,K y'Corridor Development Area (Area) to be blighted and amending
<br />".,` tax allocation provisions in the Area (Declaratory
<br />Resolution) ; and
<br />WHEREAS, the Declaratory Resolution found and determined
<br />that an area within the City of South Bend, Indiana (City)
<br />designated by the Commission as the Studebaker Corridor
<br />Development Area (Area) continues to be blighted within the
<br />meaning of I.C. 36 -7 -14 (Act); and
<br />WHEREAS, the Declaratory Resolution further found and
<br />determined that there is a substantial presence in the Area
<br />of excessive vacant land on which structures were located?
<br />abandoned or vacant buildings, old buildings, excessive-
<br />vacancies, substandard structures, and delinquency in pziment�,
<br />of real property taxes; and
<br />WHEREAS, the Declaratory Resolution readopted the m
<br />Studebaker Corridor Development Area Development Plan
<br />(Development Plan); and - -t
<br />WHEREAS, certain Findings of Fact have been presented 'ito
<br />the Commission which concern the location, physical condition
<br />of the structures, land use, environmental influences and
<br />other economic conditions of the Area and the Commission now
<br />desires to adopt and confirm the Findings of Fact for the
<br />Area; and
<br />WHEREAS, the Area Plan Commission of St. Joseph County,
<br />Indiana (Plan Commission) at its regular meeting on the 15th
<br />day of September, 1987, adopted and approved its Resolution
<br />No. 94 determining that the Declaratory Resolution and the
<br />Development Plan for the Area conform to the plan of
<br />development for the City and approving, ratifying and
<br />confirming the Development Plan; and
<br />WHEREAS, the Common Council of the City of South Bend,
<br />Indiana, at its meeting on the 28th day of September, 1987
<br />adopted Resolution No. 1536 -87, which approved the resolution
<br />of the Plan Commission, found and determined that the Area
<br />continues to be blighted, and adopted the Development Plan
<br />for the Area; and
<br />WHEREAS, the Commission caused to be published a Notice
<br />of Public Hearing concerning the Area on the 2nd day of
<br />October, 1987, and filed by hand delivery a copy of that
<br />notice in the offices of the Plan Commission, the Board of
<br />Zoning Appeals, the Board of Public Works, the Park Board and
<br />the Building Commissioner; and
<br />WHEREAS, at the hearing held by the Commission on the
<br />23rd day of October, 1987, at 10:00 o'clock a.m., Eastern
<br />Standard Time, at 1200 County -City Building, South Bend,
<br />Indiana, the Commission heard all persons interested in the
<br />proceedings and received D written remonstrances and
<br />objections that had been filed, and considered those
<br />remonstrances and objections, if any, and such other evidence
<br />presented.
