WHEREAS, Resolution No. 762 and the Studebaker Corridor Development Area Development Plan (Plan) adopted by Declaratory Resolution No. 762 on January 10, 1986, was confirmed by Resolution No. 764 adopted on February 14, 1986; and WHEREAS, Resolution No. 762 was amended by Resolution No. 801 adopted on April 24, 1987, and confirmed by Resolution No. 804 adopted on June 26, 1987; and WHEREAS, the Commission has previously caused to be prepared maps and plats of the Area which show boundaries of the Area, the location of the various parcels of property, streets, alleys and other features affecting the acquisition, clearance, replatting, replanning, rezoning, or redevelopment of the Area, indicating the parcels of the property to be excluded from acquisition and the parts of the Area that are to be devoted to public ways, levees, sewerage, parks, playgrounds, and other public purposes under the Development Plan; and WHEREAS, the Commission finds it desirable and necessary to amend Resolution No. 762 to comply with Public Law 393 -1987 (ss). NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT COMMISSION, GOVERNING BODY OF THE CITY OF SOUTH BEND DEPARTMENT OF REDEVELOPMENT, as follows: 1. Section 13 of Resolution No. 762 shall be amended in its entirety to read as follows: Property taxes and property tax proceeds as used in this resolution shall mean taxes imposed under I.C. 6 -1.1 on real property and twenty five percent (25 %) of the taxes imposed under I.C. 6 -1.1 on depreciable personal property. 2. The Commission hereby readopts the Plan as previously amended and directs the Secretary to file a certified copy of the Plan, as amended, with the minutes of this meeting. 3. All other findings, determinations, and conclusions in Resolution No. 762, as amended by Resolution No. 801, shall remain as stated therein. Co 4.
