NEMETH, FEENEY c~ MASTERS, P.C. <br />ATTORNEYS AT LAW <br />South Bend Common Council <br />February 9, 2005 <br />Page Two <br />The Petitioner wants to annex Lots 39 and 40 into the City of South Bend. These <br />two lots currently are zoned R Residential under the County Zoning Ordinance. The lots <br />are vacant. There are no houses on these lots. The Petitioner requests that Lots 39 and 40 <br />be rezoned to CB Community Business. <br />The Petitioner understands that it is necessary to file a separate petition before the <br />South Bend Board of Zoning Appeals for a special exception to use these lots for <br />automobile sales within the CB Community Business zoning classification. That petition <br />will be filed and scheduled for hearing before the Board of Zoning Appeals on March 17, <br />2005. The Area Plan Commission hearing on the rezoning petition will be set for hearing <br />on March 15, 2005. It is anticipated that the petition for annexation, rezoning and for a <br />special exception will all come before you for public hearing on the same schedule. <br />To summarize, this petition requests the following: <br />Annex Lot 39 and Lot 40; <br />Rezone Lot 39 and Lot 40 to CB Community Business; and <br />Rezone Lot 42 from SF1 Single Family to CB Community Business. <br />Petitioner's petition for a Special Exception for Lots 39, 40 41 and 42 for Automobile <br />Sales within the CB Community Business zoning classification will be sent to you for <br />public hearing and approval after a hearing before the Board of Zoning Appeals. <br />Your approval of this petition is requested.
