REGULAR MEETING <br />APRIL 10, 2012 133 <br />crosswalk. Regarding Options 2 and 3, a traffic <br />signal upright is within the five feet wide <br />pedestrian path. It appears that it is situated in such <br />a way that the clearance around it will be less than <br />the thirty -inch minimum needed to pass a wheel <br />chair. There may be one street light post and a <br />parking regulation sign or two within the path also. <br />The Department of Justice access board allows one <br />construction of no less than thirty inches within <br />each 200 feet of sidewalk. The City's standard has <br />always been a full five feet width for ADA access. <br />The restaurateur may be able to adjust the position <br />of the rail to overcome these problems. He will <br />need to decide if that eliminates too much seating. <br />APPROVAL OF MASSAGE ESTABLISHMENT LICENSE RENEWAL APPLICATION <br />Mr. Gilot stated that the Board is in receipt of favorable recommendations from the Building <br />Department, and the Police and Fire Departments for a Massage License Renewal Application <br />from XLT, LLC, dba Illusions, 2123 Edison Road, South Bend, Indiana 46637. Upon a motion <br />made by Ms. Roos, seconded by Mr. Gilot and carried, the License Application was approved. <br />APPROVE LICENSE APPLICATIONS — OPEN -AIR LICENSE <br />Mr. Gilot advised that the following open -air license applications have been received: <br />Name: Smiley Dogs <br />Location: Southwest Corner of Michigan Street and Jefferson Boulevard <br />Intersection <br />Remarks: Engineering noted corrections on the diagram of the location <br />Name: Smiley Dogs <br />Location: Southwest Corner of Main Street and Washington Street <br />Intersection <br />Remarks: Engineering stated there is no objection to the renewal on the <br />same terms as the prior years including the clearance around the <br />nearby historic marker. Community and Economic Development <br />stated they would like to keep this corner open for a different type <br />of vendor. They noted there are already two hot dog vendors in <br />this vicinity. <br />Ms. Greene stated the Board does not have anything in place that would authorize them to limit <br />the number of hot dog stands in the downtown area. Therefore, upon a motion made by Ms. <br />Roos, seconded by Mr. Gilot and carried, the above license applications were approved and <br />referred to the Administration and Finance for issuance. <br />APPROVE TRAFFIC CONTROL DEVICES <br />Upon a motion made by Ms. Roos, seconded by Mr. Gilot and carried, the following traffic <br />control devices were approved: <br />NEW INSTALLATION: Handicapped Accessible Parking Space Sign <br />LOCATION: 1726 E. Bowman Street <br />REMARKS: Favorable Recommendations <br />NEW INSTALLATION: Residential Permit Parking Only /Tow Zone <br />LOCATION: South Side of 300 Block of West Marion Street <br />REMARKS: Favorable Recommendations <br />APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO <br />REMONSTRATE — 17381 DARDEN ROAD — KEY NO. 002-2016-0336.34 - WATER <br />Mr. Gilot stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to <br />Remonstrate as submitted by Mr. and Mrs. Rodney Lee and Debra McClain, 17381 Darden <br />Road, South Bend, Indiana 46635. The Consent indicates that in consideration for permission <br />to tap into public water system of the City, to provide water service to the above referenced <br />
