CBRE (Bradley <br />ROBERT BRADLEY ASSOCIATES, LLC <br />DB /A CB RICHARD ELLIS I BRADLEY <br />BROKERAGE AND MANAGEMENT <br />LICENSED REAL ESTATE BROKER <br />LEASING COMMISSION AGREEMENT <br />(SINGLE PROSPECT) <br />1 The undersigned ( "Owner ") hereby confirms the following commission agreement with ROBERT <br />BRADLEY ASSOCIATES, LLC D/B /A CB RICHARD ELLIS I BRADLEY ( "Broker "), concerning the <br />lease of all or portions of the real property hereinafter described as 329 S Lafayette Blvd, South Bend, IN, <br />46601 and 130/202 E Sample St, South Bend, IN 46601(the "Property ") during the period commencing <br />March 12, 2012, and ending midnight June 15, 2012 (the "Term ") to the prospective tenant represented by <br />Christian Davey of Grubb & Ellis (the "Tenant "). <br />2 Owner agrees to pay Broker a commission of Two Thousand Two Hundred Fifty dollars ($2,250.00) upon <br />execution of this contract. If the Property is ]eased during the Term to Tenant or if within one hundred <br />twenty (120) days after the end of the Term: (a) the Property is ]eased to Tenant, (b) Owner enters into a <br />contract for the lease of the Property with Tenant, or (c) negotiations continue, resume or commence and <br />thereafter continue leading to a lease of the Property to Tenant, Owner agrees to pay Broker an additional <br />Three Thousand Five Hundred dollars ($3,500.00), due upon lease execution. <br />3 It is expressly understood that this agreement shall not be construed as a listing agreement. <br />4 All negotiations with Tenant shall be through Broker. Broker shall provide Tenant with leasing proposals <br />and coordinate all efforts required for proposal and lease execution. <br />5 Owner acknowledges that, with respect to this transaction, Broker represents the Owner only. <br />6. Owner agrees to disclose to Broker and to Tenant any and all information which Owner has regarding <br />present and future zoning and environmental matters affecting the Property and regarding the condition of <br />the Property, including but not limited to relevant structural, mechanical and soils conditions, the presence <br />and location of asbestos, PCB transformers, other toxic, hazardous or contaminated substances, and <br />underground storage tanks, in, on or about the Property. Broker is authorized to disclose any such <br />information to Tenant. <br />7. This Agreement constitutes the entire agreement between Owner and Broker and supersedes all prior <br />discussions, negotiations and agreements, whether oral or written. No amendment, alteration or <br />cancellation of this Agreement shall be valid or binding unless made in writing and signed by both Owner <br />and Broker. This Agreement shall be binding upon the heirs, successors and assignees of the parties. <br />8. The parties hereto agree to comply with all applicable federal, state and local laws, regulations, codes, <br />ordinances and administrative orders having jurisdiction over the parties, property or the subject matter of <br />this Agreement, including, but not limited to, the 1964 Civil Rights Act and all amendments thereto, the <br />Foreign Investment In Real Property Tax Act, the Comprehensive Environmental Response Compensation <br />and Liability Act, and the Americans With Disabilities Act. <br />The undersigned Owner hereby acknowledges receipt of a copy of this Agreement and the Schedule. <br />APPROVED this day of <br />Signature Page follows <br />2012 <br />
