rubbish and weeds. Roads and pavements shall be kept true to <br />line and grade and in good repair. <br />e. Landscaping which is the responsibility of the Owner or the <br />Occupant, as more particularly set forth in Section 7.4 herein, shall <br />be maintained in a neat and healthy growing condition in <br />accordance with the Guidelines. <br />8.16 Maintenance Compliance. If minimum maintenance standards are not met <br />by the Owner or Occupant, the Board shall issue a notice to the Owner or <br />Occupant requesting action. If the maintenance deficiency is not remedied <br />within ten (10) days, the Board shall have the maintenance work performed <br />and shall charge said Owner or Occupant all costs incurred. If such costs <br />or any part thereof are not paid within ten (10) days after written demand <br />therefore, the amount unpaid shall bear interest from the date thereof until <br />the date of payment at the rate of interest set forth in Section 6.7 herein. If <br />any such fees or costs are not paid on the due date thereof, the <br />Association shall proceed as permitted in Article IX herein. <br />ARTICLE IX <br />VIOLATION OF PROVISIONS <br />9.1 Abatement and Suite. The Declarant, the Committee and the Association <br />are each hereby granted the right to enter upon any Lot in Blackthorn at <br />any reasonable time or times to inspect the same for purposes of <br />determining compliance with Committee approved plans and <br />specifications, the Covenants and the Guidelines. In the event any such <br />violations and breaches are not cured within fifteen (15) days after written <br />demand made upon the Owner or Occupant by the Declarant, Committee <br />or Association, as the case may be, the Declarant and the Association <br />jointly and separately have the right to enter upon the Lot upon which such <br />violation or breach exists, and summarily abate and remove, or correct, <br />repair or maintain, at the expense of the Owner and Occupant thereof, any <br />Improvement, thing or condition that may be or exist thereof contrary to the <br />intent and meaning of the provisions hereof as interpreted by the <br />Declarant, the Committee and the Association, and the Declarant, the <br />Committee and the Association shall not, by reason thereon, be deemed <br />guilty in any manner of trespass or conversion for such entry, abatement, <br />removal, correction, repair, or maintenance or incur any liability on account <br />thereof.
