ARTICLE IV <br />USE RESTRICTIONS <br />4.1 Prohibited Uses. Any use that, in the opinion of the Commission or the <br />Committee, could produce adverse effects upon Blackthorn in terms of <br />the health, safety or welfare of Persons; or which may be harmful to the <br />Improvements thereon; or which in the opinion of the Committee does not <br />agree with the intent of the development plan for Blackthorn as generally <br />described in Article II hereof and in the Guidelines; is prohibited, including <br />without limitation, the following: <br />a. noxious, toxic or corrosive fumes, gases, or discharges <br />b. smoke or offensive odors <br />C. ground conditions which will produce dust <br />noise and /or vibration <br />e. intense glare or heat <br />outdoor storage of any type <br />g. drive -up facilities of any type <br />convenience stores and gas stations, or any type of automotive <br />service <br />free standing restaurants <br />adult uses, as defined by the South Bend Municipal Code as of the <br />date of the adoption of these Covenants <br />k. outdoor advertising signs, commonly referred to as billboards <br />(Amended 6116195, Doc. # 9520538 & # 9520537) <br />4.2 Uses not specifically permitted. Uses not specified as permitted are <br />prohibited unless approved by the Commission. <br />4.3 Limitations on Truck Traffic. Truck Traffic in Blackthorn is limited to <br />delivery service required for normal, day to day operations. Trucks with <br />more than three (3) axles or over ten thousand (10,000) pounds gross <br />vehicle weight (particularly semi - trailer trucks) are prohibited from general <br />business activity in Blackthorn.
