379 <br />The following complaints were reported on by the Pole and Wire Inspector <br />and the said reports approved by the Board. ° <br />Complaint about telephone pole in way of new fence at 1608 Fassnacht . <br />Ave, filed by Micheal Golmbowski. Reported on as follows:- This is a Central Union <br />Tel. pole and it stands -on the mains lot about ten (10) inches. The pole, should be <br />trenched into the alley. This' will do when the frost is out of the ground-. I. & M. <br />Elea Co. is jointly , on the pole No. 11869. poleowned by C. U. Tel. C'o. <br />The following complaint received and filed -'by the -'Board'. - <br />To the Honorable Board of Public Works, <br />The Indiana &- Michigan Electric Company have been setting poles in streets <br />r:nd alleys with out permits. The Light Co. has set a long line of poles on South <br />Franklin, Q_treet. Two poles on Fassancht and Wilber and one pole south Scott.,St. by <br />L. S & M. S. R. R. and this pole at Walnut and Dit. St0 <br />in one place the owner of a new storeroom complained about poles and <br />anchors in front off' his'storeroom where -he wanted to build a sidewalk at the corner of <br />Division and Walnut Street. This Board had given the Light & Home Tel. Co. notice to <br />remove. the pole. and anchors from in front of this plee. <br />TEDS `. H. BEANING. <br />Bond of contractor of Rock S imire for the sum of One Thousand ($1, 000. 00 ) <br />Dollars and signed by London & Lancashire Indemnity Company of America as Surety <br />c� was approved by the Board. <br />' Petition for a pipe sewer on Olive Street from Washington Avenue to <br />Linden Avenue filed with Board. The same , was referred to the City Engineer for a <br />gyres glut ion, . <br />-Ur. James A. Judie appeared before the Board in regard to what position <br />the said Board was to take in the matter of Opening of William Street from Colfax Avenue <br />`tea Lincoln Way West, before he started to build his garage on Colfax Avenue where said <br />proposed street was t-o start. <br />The Board informed Mr. Judie that after considering the matter and con- <br />sulting with the City. Controller U. G. Manning, find that there will be a shortage of <br />funds in the sum of Eighteen Thousand ($189000.00)Dollars because of Liquor licenseeft. and <br />they ,could not take any funds out of the General Treasury to apply on assessments that <br />City would have to pay and by unanimous consent of the Board does hereby abandon this <br />improvement by said opening. <br />The. foll§wing resolutions were adopted by the Board. <br />LOCAL. SEWER IMPROVEMENT RESOLUTION No. 485. <br />Resolved.by.the Board of Public Works of the City of South Bend, County <br />of St. Joseph, State of Indiana, That the c onstruct ionof a local sewer, intended and <br />adapted only for local use by the property holders whose propertyabuts thereon, and not <br />intended or adapted for receiving sewerage from collateral drains,be and the same is, <br />hereby ordered in and along Ostemo Avenue from Iroquois Street to Lafayette Street <br />as follows, to -wit: - <br />Beginning at the intersection of the center line of Iroquois Street <br />and Ostemo Avenue; thence east along the center line of Ostemo Avenue to the center <br />of the first alley east of Iroquois Street with a 12 inch vitrified pipe sower; thence <br />still east along the center of Ostemo Avenue to the center of Lafayette Street with a <br />10 inch vitrified pipe sewer. Together with the necessary manholes, storm water inlets, <br />enduits and house connections to the curb 1 ine •along the line of said improvement. All as <br />shown on the plans and in accordance with the profiles, detail drawings and specifications <br />on file in the office of the Department of Public Works of the City of South Bend, <br />Indiana,and said sewer, with all its appurtenances shall be constructed in accordance with <br />iihe profile and spec if icat ionsnow on file in the office of the Deartment of Public Works <br />of said City. The cost of said improvement shall be apportioned against and paid by the grope <br />property holders whose property, bbuts thereon, and uon the City of South Bend if the <br />City is be°nef itted in said improvement, all a ccording tq the method and manner provided <br />f orin Act Of the General Assembly of the State of Indiana, wntitled " An Act Concerning <br />Municipal Corporations,, " approved Mar ch 6,1905. Assessments, if deferred, are to be <br />paid in ten equal annual installments, with interest at the rate of Six per cent per <br />annum. A bond or bonds shall be issued to the contractor in payment for such work, unless <br />the property owners pay said assessments before said bond or bonds are issued. Under no <br />circumstances shall the City of South. Bend be or be held responsible for any sum or sums <br />due from said property owner or owners for said work, or for the collection of same, or for <br />the payment of any bond or bonds, certificate or certificates, issued to said contractor <br />in payment for such work, except for such moneys as shall have been actually received <br />by the City from the assessments for such improvement, or such moneys as said City Is by <br />
