In the nbove matter no ren-onstrators appeared and no written remon- strance was filed, the. i?oard therefore sustain all former action taken and declare the above d.eseribed -property in all things vacated and this resolution in al-1 thing ratified, confirmed and approved Resolved further, that the Cit=° Engineer be instructed to prepare a roll showing awards of damages and assessments of benefits: to all parties and proper -ties interested in the above matter. Studebaker, by his attorney, and respectfully remonstrates against the assessment against his lots and lards described in the asaess-?aent roll herein for sewer connections and extensions on Eddy Street and % isha,;ua.ka Avenue, in the City of South Bend, and for cause of remonstrance says: f l) Said assessment of $1434* 40 is excessive and out of proportion to the benefits to his said lots and lAnds against �-vhi:�h assessments are made. (2) Assessments against his lots and lands, aggregating 81434.40, are made for sewer connections and extensions a distance of from twenty to thirty feet east of and outside of Eddy Street. J. N.
