Board met in sp9c ial session at <br />11:45 A.M. All members present. <br />Mr. Vernon C. Hastings appeared before the Board and presented <br />plat, of Shively Addition. No. action tt�ken. <br />Mr.. tam.-N. Bergen appeared before the Board and filed petition for <br />-)ipe sewer on East Miner Street from Notre Dame Avenue to St. Peter Street, <br />also -filed waiver for the same us follows:- Board ordered resolution prepared., <br />so same could be adopted to day. . <br />W A I V E R <br />South Bend, Indiana October 18,1016. <br />TO THE BOARD OF -PUBLIC WORKS <br />SOUTH BEND INDIANA. - <br />WHEREAS, the Board of Public Works of the City of South Bend, <br />Indiana, aid,.on the 18th. day of October 1916 adopt a preliminary resolution <br />for the improvement of East diner Street from North St. Peter Street to North <br />Notre Dame Avenue,'in the City of South Bend, Indiana, by construction of a sewer, <br />also the -construction of the necessary°manholes, and inlets, water inlets, <br />conduits and resetting of all manholes and inlets to the proper grade, All as <br />shown on the plant, and in accordance with the profiles, detail drawings, and <br />specifications on file in - the off Ice of the Department of ;Public Works. <br />And whereas, we, the undersigned, are the only persons owning <br />property on said street to be improved, and that we alone are affected in any way <br />by said proposed improvement. That we are the sole owners of the separate <br />parcels of land bordering upon said street proposed to be imnrved. <br />Therefore, in consider at ion bilat said Board of Public Works pro- <br />ceed to improve said street as proposed in said resolution W and for the further <br />purpose of saving time andpex ense, we, the undersigned, do hereby waive all ob- <br />jections and defense to any defect in said proceedings, and to any violation in <br />procedure for the improvement of streets as fixed by Section 8710 of Burns' <br />revised Statutes of 1914. We further waive any and all objections to the fact that <br />neadveftisement for hearing was published as required by law, and that no notices <br />were mailed to the owners -of property and that no hearing was had by said Board. <br />We also consent that said Board shall proceed to let the contract <br />for doing said work in the following manner:- <br />That they shall notify by mail responsible contractors in the City <br />of South Ben-d, Indiana, of said work to be done under said resolution, and that <br />they shall receive bids from said contractors for -the doing of said work, and they <br />sall let the contract for the doing of said work to the lowest responsible bidder. <br />And we -waive any objection to the action of said Board in letting said contract <br />in a form and manner other than provided by said Seet'ion 8710. <br />And we further consent that the cost of doing said work shall be <br />assessed against the different parcels of real estate owned by us as provided by <br />Sections 871098711,8714987159871698717 087189 of Burns' Revised Statutes of 1914. <br />And we further agree that notices given us by mail shall be <br />sufficient notice of the hearing upon hhe assessments made for said improvement. <br />Given under our hands on the day and year first above mentioned. <br />WILLIAM N.
