That the construction of a local sewer, intended and adapted only for local use by theproperty holders whose property abuts thereon, and Inot intended or adapted for receiving sewerage from collateral dr� ��OC�efana th the 9&me is , hereby ordered in and along McPherson Street ,from a po r� south of the south line of Thomas Street to a point 100 feet north of the north lire of Division Street as follows, to -wit: -Beginning at the intersection of the center line of Napier Street and McPherson Street; thence north along the center line of McBh�rson Street to a point 100 feet south of the south line of Thomas Street with a 10 inch vitrified pipe sewer. Also, beginning at the intersection of the center line of Napier Street and McPherson Street; thence south along the center line of Mc Pherson Street to a. point 100 feet north of the north line of Division Street with a 10 inch vitr `_'ied -)ipe sewer. Together with the necessary manholes:, inlets conduits and house connections to the curb line along the line of said improvement. A?1 as sho, on the nlAns and in accordance with the profiles, detail drawings and specifications orfile in the office of the Department of Public Works of the City of South Bend, Indiana, and said sewer, with 9,11 its appurtenances shall be constructed in accordance with the profiles ar'd s-:-)ecificaions now on file in the office of the Department of Public Works of said City. The cost of said _ 'improvement shall be apportioned against and paid by the property holders whose pro- perty abuts thereon, a d upon hhe City of South Bend if the City is benefitted by said imp-rovament, all according to the method and manner provided for in Act of the General Assembly of the State of Indiana, entitled ".An Act Concerning Municipal Corporat ions, " approved March 5,1905. Assessrients,if deferred, a:re to inst9llments rith interest a.t the -rate ,:f six per cent be paid in ten equal annual Der =gnnum. A bond or bonds shall be issued to the contractor in pa�,ment for such work, unless the property owners pay said assessments before said bond or bonds are issued. Under no circ�.mstances shall t'!e CitJ' O` S-at,lh B-nd be or be held resuonsib'e for any sum or sums due from said property owner or owners for said Fork or for the colle ction of same, or for the pa�rmer_t of any bond or bonds, certi- ficate or certificates, issued to said contractor in paymant for such work, except for such moneys as shall have been actually received by the City from the assess - merits for such improvement, or such moneks as said City is by said above entitled Act Required to pay.
