Continued. <br />Engineer filed arse dsment Tolland final a stima:_Ue for pipe sewer on Caroline <br />Street from Lincoln Way East to Dayton Street, under Improvement Resolution No. 414. <br />In the City of South Bend, Indiana. <br />Resolved, that n6bices as to the amounts of assessments as required by <br />statute be pu'01+shed on the Sth. day of July 1916 and on the 15th. day of July 1916 <br />in the South Bend Daily Tribune, Stating that this Board will give a hearing on the <br />amount of such assessments at its office in the City Hall on the 25th. day of July <br />1916 at 7:45 P-M, <br />Resolved further, that the entire work under the above contracts be <br />accepted and approved and the final estimate thereon allowed. notice of this resolu- <br />tion shall be publis ed on the Sth. day of July 1916 wnd on the 15th. day of July <br />1916 in the South Bend Daily Tribune, stating t at .,t is Board will give h heaving on <br />the acceptance of such work, at its office in the City Hall on the 25th. day of July <br />1916 at 7:45 P.M. <br />Concerning the improvement of the roadway. of 1st. alley west of <br />La-fayette Street from Colfax Avenue to La Salle Avenue in pursuance to Resolution No <br />431.th.e Board finds that no petition has been filed with said Board by a majority <br />in number of the freeholders residing on said street to be improved requesting that <br />it be improved with a different kind of pavement than the kind heretofore adopted <br />by the Board in its preliminary order; and the City Engineer reports that C. H. <br />De Frees is the lowest and best bidder for the kind of pavement heretofore adopted by <br />the Board, and the Board find that said C. H. De gees is the lowest and best bidder <br />and hereby lets thde egntract f r said improvement t hhijn and ordgrs that aid <br />dmproveme t be made with Asphaltic Concrete Tr n daod La �) and a proceedings heretofe <br />had in this natter are hereby confirmed and ratified. <br />E. Sweeney, Clerk of Board. <br />Dated July 5th.91916. <br />SIDEWALK IMPROVEUENT RESOLUTION NO. 461. <br />Resolved by the Beard of Public Work - of the sty of South -Bend, St. <br />Joseph County, State of Indiana, That it is deemed necessary: to improve Washington <br />'Avenue from Sunnyside Avenue to Jacob Street as follows, t-o-wit: <br />By constructing cement <br />curb and cement sidewalk on both ides of said Washington Avenue from Sunayside Ave. <br />to Jacob Street. All as shorn on the plans and in accordance wit the profiles, detail <br />drawingg and specifications on file in the office of the' Department of Public Works, <br />of the City of South Bend, Indiana, in accordance with the profile, details, drawings <br />and 'specifications on file in the office of the Department of the Board of Public W <br />Works of said City, and such improvement is now ordered. <br />The cost of said improvement, including the cost of street and alley <br />intersections, shall be assessed upon the real estate abutting on said Washington. <br />Avenue all according to the method and manner provided for in an Act of the General <br />Assembly of the State of Indiana, entitled "An Act Concerning Municipal Corp-- rations," <br />approved March 6,1905, and in accordance wit and pursuant to the .provisions of all <br />amendatory and supplemental acts theretot pa sed by the General Assembly of the State <br />of Indiana. Assessments, if defered, F-re to be padd in ten equal annual installments <br />with interest at the rate of Six per cents per arum. A bond or bo ds shall be issued <br />to the contractor in payment .of such work, unle s the property owners pay said assess— <br />ments before said bond or bonds &re .issued. Under no circumstances shall the City of <br />South Bend be, or be held responsible For any sum or sums due from said property <br />owner or owners for said work or for the collection of the same, or for the payment <br />of any bond, bonds, certificate or certificates, issued to said contractor in payment <br />for such work, except for such moneys as shall have been actually received by the City <br />from the assessments for such improvement, or such moneys as said City is by said <br />above entitled Act required to pay.
