The following petition was presented to the Bof--.rd and approved. To the Board of Public Works, of the City, of Sut tkh Bend, Indiana. The undersigned, the Chicago! South Bend and Northern `Indiana. Railway Company, hereby notifies Stou that it elects to improve that portio n of Eddy Street from Jefferson Blvd. to Sample Street,, and Mishawaka Avenue Prom Sample Street to Ninetenth Street in the City of South Bend, being part of the streets described in Improvement - Resolution No. 417 which is occupied by the -tracks of said Company, and potion thereof that which said Company is bound by contract with the said City to imp rove. Such improvement will be made and constructed by said Company in the following manner. Metropolitan or other equally good paving brick to be used with such detail as to laying of the same as siAll be determined by the Board of Public Works and the City Engineer; said brick to be laid on either sand cushion or ce rent I ortar cushion and to be underlaid by sic inches of concrete extending between the ties and underneath the rail, all to the subject to further detail specifications as may be supplied by the City Engineer. This notice anci election is -iven and served under and in accordance with the laws of 1909, as set forth in '-the -Published A:ets of the General Assembly of the State of Indiana for the year 1909 at pages 4129417 , et seq. same being Section 8710 Burns R. S. 1914, and other laws and parts thereof applicable hereto.. The undersigned further hereby requests your Honorabi a Body to in — elude the paving and impEovement above mentioned an d described and the cost thereof in the gene ra l cont ra ct let by your Board for the Improvement of said Eddy Street and Mishawaka Avenue, under said Improvement Resolution No. 417.
