LOCATE SEWER IMPRDV&hENT RESOLUTION NO- 436. Resolved by the Board of Public Works of the City of South Bend, County of St. Joseph, State of Indiana, That the construction of a local sewer, intended and adapted only for local use by the property holders whose property abt,:ts thereon, and not intended or adapted for receivg sewerage from .collateral drains, be and the same is , here by ordered in and along High. Street from Broadway to a. point 100 feet north of the north line of Indiana Avenue. Also Haney Avenue from High Street to Michigan Street s.s follows, to -wit. - Beginning at the intersection of the center line of High Street and Broadway thence south along the center line of High Street to the center of.� Haney Avenue with an 18 inch vitrified pipe sewer; thence still south along the center line of High Street to a point 1QO feet no,%h of the north line of Indiana Avenue with a .10 inch vitrified: pipe sewer. Also begin at the intersection of the center line of High Street and Haney Averse* thence west along the center fine of Haney Avenue to the center of Rush Street with an 19 inch vitrified ipe sewer; thence still west along the west line of Haney Avenue to the center of Fellows S reet with a 15 inch vitrified pipe sewer; thence still west along the center of Haney Avenue t o Carroll Street with a 12 inch vitrified pipe sewer. Also begin at the intersection of the center line of Haney Avenue and Michigan Street; thence east along the center lineof Haney Avenue to the eerrtl5r of St* Joseph Street with a 15 inch vitrified pipe sewer;thence still east along the center of Haney Avenue to Carroll Street with a 12 inch vitrified pipe sewer. Together with the necessary manholes, inlets, conduits, flush tanks_ and house cor,.nections to the curb line along the line of said improvement. All as shown on the plans, profiles detail drawings, and specifications on file in the 0ffiee of the Department of Public Wor�s of the City of South Bend, Indiana., and said sewer, with all appurtenances shall be constructed in accord- ance with the profile and specifications, now on Pile in the office of the Department of Public Wolks of said City. The cost of said improvement shall be apportioned against and'paid by the property holders whose property abuts thereon, end upon the City of South Bend if the City is benefitted by st- id improvement, all according to the method. -.-and manner pro- vided for in Act of the General Assembly of the State of Indiana, entitled "An Act Concern- ing Municipal Corporations$ w approved March 6,1905• Assessments, if deferred* are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in payment for such work' unless the pro- perty owners pay said assessments before said bond or bonds issued. Under no circumstances shall the City of South Bend be oe be held responsible for any gum or sums due from said p rope rty owner or owners for said work, or for the collection of s eme, or for the payment of b nd or b n certhificate or crteate�s issu d � said ontdr�et�hr i ey ant le suc roIN, except ^uc moneys assnail-have gen ac ua y rece ve y e i�y rom ie assessments for such improvement, or such moneys as said City is by said above entitled Act required to pay. All proceedings had, and work done in the ma king of said -imp rove- ment, assessment of property, collections of assessments and issuance of bonds thereof' shall be as provided for in said above entitled Act. Notice of this resolution shall be published on the 24th. day of April 1916 and on the ltt. day of May 1916 in the South Bend Daily Tribune.
