ZONING AND ANNEXATION COMMITTEE 02 -13 -12 <br />Committee Members Present: Oliver Davis; David Varner; Dr. Fred Ferlic; Gavin Ferlic <br />Other Council Members Present: Tim Scott; Henry Davis, Jr.; Karen White; Derek Dieter; <br />Valerie Schey <br />Others Present: Marco Mariani; Phil Byrd; George Lane; <br />Kyle Chamberlin; Mark Lyons; Carol Davis; Mark Neal; <br />Kevin Allen; Kathy Cekanski - Farrand; Gary Gilot <br />Agenda: Bill No. 12 -04 — Special Exception — 505 E. Broadway <br />Bill No. 12 -05 — Special Exception — 3836 Nimtz Parkway <br />Bill No. 12 -06 — Special Exception —17917 S.R. 23 <br />Chairperson Oliver Davis opened the meeting noting the full committee was present to hear the <br />three bills under consideration. <br />Bill No. 12 -04 — This bill requests a special exception be granted for the petitioner, South Bend <br />Heritage, to reduce the number of parking spaces from the 7 required to 4 at 505 E. Broadway. <br />SBH is renovating this vacant home to serve as a property leasing office for South Bend Heritage <br />properties on the southeast side. <br />Mark Lyons reported a unanimous favorable recommendation for the request from the BZA. <br />There was no remonstrance at the BZA hearing. Marco Mariani, South Bend Heritage Director, <br />made a brief presentation providing two letters of support from nearby residents (copies <br />attached.) Marco described the rehab as a $100,000 investment in the neighborhood. <br />No one was present to speak for or against so Councilmember Varner motioned a favorable <br />recommendation. Councilmember Gavin Ferlic seconded and all affirmed. <br />Bill No. 12 -05 — This bill requests an exception be granted for the construction of 3 cell towers, <br />90' high at 3626 Nimtz Parkway. Mark Lyons, representing the BZA, reported a favorable <br />recommendation coming from the BZA hearing. <br />Mrs. Kerry Wallace, an employee of the petitioner made a brief presentation. There were no <br />remonstrators. On a motion by Councilmember Varner, seconded by Councilmember Gavin <br />Ferlic and ratified by all Bill No. 12 -05 was forwarded favorably. <br />Bill No. 12 -06 — The petitioner requested this bill be continued until the March 26, 2012 meeting. <br />Councilmember Varner so moved, Council member Gavin Ferlic seconded and all affirmed. <br />There being no further business to come before the committee at this time, Chairperson Oliver <br />Davis adjourned the meeting at 3:53 p.m. <br />
