General Manager of the E lg in Company and s igned <br />at Elg in, Ill ino,is, Julae, 3rd,.,1920.,, and. retaarred to C ommon C ouncil f or rat if scat ion, <br />City- Contractor on Var sous walks in the City was ordered to place <br />the following: - <br />Cut c orner of Golden and Woodward Avenue and -out in new curb and <br />walk and_ and also Park Avenue and Old Hodson Court, out back and place new curb and <br />Walk . <br />Bond and contract for the pavement on College Street returned unsigned <br />by the Williston Construction Company with the following communication, which was <br />read and placed on file. <br />June 4th.,1920. <br />Board of Public Works, <br />South Bend, Ind. <br />Gentlemen: - <br />Referring to the contract for the pavement of College St., from Lincoln <br />Way West to Vassar Avenue., which was awarded to us by your Board on June 1st., <br />We wish to advise that investigation shows that the total amount of <br />this contract, less the City's share for intersections, is in excess of 50% of the <br />assessed valuation of the property abutting. <br />Since the 1&w forbids the awarding of a contractin excess of 50% of the <br />assessed valuation, unless the consent of thw owners to be assessed is secured within <br />ten days from the taking of bids, which unfortunately was not secured in this case,. <br />our attorneys have advised us that 'the legality of this contract is doubtful <br />and we, therefore, request that your Board rescind their award. <br />Yours very truly, <br />WILLISTON CONSTRUCTION COMPANY <br />BY E.
