Bond and contract for the pavement on College Street returned unsigned by the Williston Construction Company with the following communication, which was read and placed on file. June 4th.,1920. Board of Public Works, South Bend, Ind. Gentlemen: - Referring to the contract for the pavement of College St., from Lincoln Way West to Vassar Avenue., which was awarded to us by your Board on June 1st., We wish to advise that investigation shows that the total amount of this contract, less the City's share for intersections, is in excess of 50% of the assessed valuation of the property abutting. Since the 1&w forbids the awarding of a contractin excess of 50% of the assessed valuation, unless the consent of thw owners to be assessed is secured within ten days from the taking of bids, which unfortunately was not secured in this case,. our attorneys have advised us that 'the legality of this contract is doubtful and we, therefore, request that your Board rescind their award.
