A RESOLUTION OF THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA,
APPROVING A PETITION OF THE SOUTH BEND
BOARD OF ZONING APPEALS
FOR THE PROPERTY LOCATED AT
1939 CHARLES STREET, SOUTH BEND, INDIANA
WHEREAS, Indiana Code Section 36-7-4-918.6, requires the Common Council to give
notice pursuant to Indiana Code Section 5-14-1.5-5, of its intention to consider Petitions
from the Board of Zoning Appeals for approval or disapproval; and
WHEREAS, the Common Council must take action within sixty (60) days after the
Board of Zoning Appeals makes its recommendation to the Council pursuant to I.C. 36-
7-4-918.6; and
WHEREAS, the Common Council is required to make a determination in writing on
such requests pursuant to Indiana Code Section 36-7-4-918.4, and
WHEREAS, the South Bend Board of Zoning Appeals has made a recommendation,
pursuant to applicable state law.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF
THE CITY OF SOUTH BEND, INDIANA as follows:
SECTION I. The Common Council has provided notice of the hearing on the Petition
from the Board of Zoning Appeals pursuant to Indiana Code Section 5-14-1.5-5,
requesting that a Special Exception be granted for the property located at: 1939 Charles
Street, South Bend, Indiana 46637 in order to permit Off-site parking in a "SF-1"
District.
SECTION II. Following a presentation by the Petitioner, and after proper public hearing,
the Common Council hereby approves the petition of the South Bend Board of Zoning
Appeals, a copy of which is on file in the Office of the City Clerk.
SECTION III. The Common Council of the City of South Bend, Indiana, hereby finds
that:
1. The proposed use will not be injurious to the public health, safety,
comfort, community moral standards, convenience or general welfare;
2. The proposed use will not injure or adversely affect the use of the adjacent
area or property values therein;
3. The proposed use will be consistent with the character of the district in
which it is located and the land uses authorized therein;
4. The proposed use is compatible with the recommendations of the City of
South Bend Comprehensive plan; all of which is requested by the South
Bend Municipal Code § 21-09.03 (i).
SECTION IV. Approval is subject to the Petitioner complying with the reasonable
conditions established by the Board of Zoning Appeals which are on file in the office of
the City Clerk. "
SECTION V. The Resolution shall be in full force and effect from and after its adoption
by the Common Council.

Members of the Board of Zoning Appeals,
The Petitioner, FTC Properties, LLC seeks this Special Exception for the Board of Zoning Appeals of the
City of South Bend to allow the use of the petitioner's property identified above to expand the employee
parking area of the adjoining Wissco Irrigation Co., Inc. operation at 1820 South Bend Avenue, South
Bend, Indiana. The properties adjoining to the east and west are jointly owned by common parties. It is
the intent of the Petitioner to develop a paved, landscaped, fenced and screened parking area on Lot 20
of Pensinger's Subdivision to accomplish the expansion of the operations and to allow for the hiring of
additional employees and their parking.
Pursuant to this Application, the following standards for variances as set forth at I.C. 36-7-4-918.5 are
addressed as follows:
1. The approval will not be injurious to the public health, safety, morals and general welfare of
the community because of the intended use of the property for the expansion of employee
parking for the present Wissco Irrigation Co., Inc. operation at 1820 South Bend Avenue.
2. The use and value of the area adjacent to the property included in the variance will not be
affected in a substantially adverse manner because the improvements contemplated here will
be paved, landscaped and fenced as necessary to ensure no deleterious effect on adjoining
or surrounding parcels.
3. The need for the Special Exception for which the Petitioner applies arises from the peculiar
condition of the property requiring its use to allow for the expansion of available employee
parking for the property adjoining at the west and the fact that the property adjoining to the
east is owned by a commoner owner.
4. The strict application of the terms of the Zoning Ordinance will result in unnecessary hardship
on the common owner of the adjoining parcel arising from practical difficulties in the use of its
adjoining property because additional parking is essential to the ongoing and expanding
operations of Wissco Irrigation Co., Inc. and the parcel comprised of the subject allows
expansion of staff and employees to accommodate growth in the company.
5. The approval of the Petitioner's request will not interfere substantially with the comprehensive
plan adopted under the 500 series of this chapter.

Dear Council Members:
The above referenced petition of FTC Properties LLC was legally advertised on December 6, 2007.
The Board of Zoning Appeals gave it a public hearing on December 20, 2007 at which time the following
action was taken:
Upon a motion by Mr. Sassano, being seconded by Mr. Kilbase and unanimously carried,
the petition for Special Exception to allow off site parking in a "SF1" District, on property located
at 1939 Charles Street, is sent to the Common Council with a Favorable Recommendation.
The deliberations of the Board of Zoning Appeals and points considered in arriving at the above decision
as shotivn in the Minutes of the Public Hearing, and will be forwarded to you at a later date, to be made
part of this report.
