RESOLUTION.; WHEREAS a contract for the pavement of Calvert .Street- between Michigan Street `to High Street was awarded to the ! Western Construction Company - on April 30.'1919 and WHEREAS ,'-uaavdidable delay on 'the part of the Park Board of the City of South ` Bend and the County Commissioners of St. Joseph County, 8.outh . Bend, Indiana have ' pfaoed _the contractor "in'a position where he could not do said Work, and this Board is in receipt of a communication from this contractor( The western Construction Company by Fred Rankert, President) O'Sking for the realtion of this contract, and WHEREAS , a meeting of the Board of Public Works was held January l9th. ,1920 . at which meeting the property owners on Calvert Street were present and the -whole matter was discussed and this Board 'j were requested by the property owners to rescind the contract of the Western Constructiob Company and the property owners would file a new petition asking the Board; to start new resolution on said improvement, NOW THEREFORE BE IT RRSOLVED, That the contract entered into between the City of; South Bend through its Board of Public Works with the Western Constructin Company on April 30tb.,1919 for the pavement of Calvert Street from michigan Street to High Street is hereby rescinded and the Board teleased and and the Engineer is hereby Instructed to prepay$ a new resolution ror the pavement of the Calvert Street based on the new petition of the property! owners now on file in this office . Gentlenen: - On April 30,19199 this Company entered Honorable Board for the improvement of Calvert St Street in the City of South Bend, Under the terms of the contract the wo completed on or before July 30,1919.
