JOINT RESOLUTION OF <br />SOUTH BEND REDEVELOPMENT COMMISSION AND <br />SOUTH BEND BOARD OF PUBLIC WORKS <br />RESOLUTION NUMBER 861 <br />OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />RESOLUTION NUMBER 30 -1988 <br />OF THE SOUTH BEND BOARD OF PUBLIC WORKS <br />WHEREAS, the South Bend Redevelopment Commission has caused <br />to be construced an elevated pedestrian walkway ( "the Skywalk ") <br />interconnecting with and opening into Century Center, traversing <br />across and above St. Joseph Street (United States Highway 33 <br />North) between East Washington Street and East Colfax Avenue in <br />the City of South Bend, Indiana, and interconnecting with and <br />opening into the mezzanine level of the Marriott Hotel in the 1st <br />Source Center; and <br />WHEREAS, the South Bend Board of Public Works is the owner <br />and titleholder of record of Buildings 3, 4, and 5 of Century <br />Center, as depicted on Exhibit "I", attached hereto and <br />incorporated herein, and is the lessee of Buildings 1 and 2 <br />depicted on Exhibit "I" ; and <br />WHEREAS, the South Bend Redevelopment Commission desires to <br />convey all of its right, title and interest in and to the Skywalk <br />to the South Bend Board of Public Works, and the South Bend Board <br />of Public Works desires to accept such conveyance; and <br />WHEREAS, IC36- 1 -11 -8 provides that a governmental entity may <br />transfer or exchange property with another governmental entity <br />upon terms and conditions agreed upon by those entities by <br />adopting a substantially identical resolution, and that such <br />transfer may be made for any amount of real property, cash, or <br />other personal property as agreed upon by the entities. <br />NOW, THEREFORE, BE IT RESOLVED by the South Bend <br />�+ Redevelopment Commission and the South Bend Board of Public Works, <br />as follows: <br />1. For good and valuable consideration given each to the <br />other, receipt of which is hereby acknowledged, the South Bend <br />Redevelopment Commission hereby conveys to the South Bend Board of <br />Public Works and the South Bend Board of Public Works hereby <br />accepts conveyance from the South Bend Redevelopment Commission of <br />the Skywalk, which is more particularly described as follows: <br />PARCEL I: A portion of a pedestrian walkway 22.00 feet in <br />width over and above that portion of St. Joseph Street <br />(U.S. 33) adjoining Lot 3 of the River Bend Addition to the <br />City of South Bend, Indiana as recorded in the Office of the <br />Recorder of St. Joseph County, Indiana in Plat Book 31, Page <br />"R ", more particularly described as follows: <br />
