<br />RESOLUTION OF THE CITY OF SOUTH BEND REDEVELOPMENT
<br />COMMISSION CONFIRMING RESOLUTION NO. 867, REDECLARING
<br />THE SOUTH BEND CENTRAL DEVELOPMENT AREA TO BE BLIGHTED
<br />AND AMENDING THE DEVELOPMENT PLAN
<br />WHEREAS, the City of South Bend Redevelopment Commission
<br />( "Commission "), governing body of the City of South Bend Department
<br />of Redevelopment ( "Department ") on February 10, 1989, adopted
<br />Resolution NO. 867 (The "Declaratory Resolution ") redeclaring the
<br />South Bend Central Development Area to be blighted, amending the
<br />Development Plan and reapproving the Development Plan as amended;
<br />and
<br />WHEREAS, the Declaratory Resolution found and determined that
<br />an area within the City of South Bend, Indiana ( "City ") designated
<br />by the Commission as the South Bend Central Development Area,
<br />( "Area ") is and continues to be blighted within the meaning of I.C.
<br />36 -7 -14 ( "Act "); and
<br />WHEREAS, the Declaratory Resolution further found and
<br />determined that there is a substantial presence in the Area of
<br />excessive vacant land on which structures were located, abandoned
<br />or vacant buildings, old buildings, excessive vacancies,
<br />substandard structures, and delinquency in payment of real property
<br />it taxes; and
<br />WHEREAS, the Declaratory Resolution readopted the South Bend
<br />Central Development Area Development Plan, as thereby amended
<br />( "Development Plan "); and
<br />WHEREAS, certain Findings of Fact have been presented to the
<br />Commission which concern the location, physical condition of the
<br />structures, land use, environmental influences and other economic
<br />conditions of the Area and the Commission now desires to adopt and
<br />confirm the Findings of Fact for the Area; and
<br />WHEREAS, the Area Plan Commission of St. Joseph County, Indiana
<br />( "Plan Commission ") at its regular meeting on the 21st day of
<br />February, 1989, adopted and approved its Resolution No. 104
<br />determining that the Declaratory Resolution and the Development
<br />Plan, as amended, for the Area conform to the plan of development
<br />for the City and approving, ratifying and confirming the
<br />Development Plan, as amended; and
<br />®WHEREAS, the Common Council of the City of South Bend, Indiana,
<br />at its meeting on the 27th day of February, 1989, adopted
<br />Resolution No. 1708 -89, which approved the resolution of the Plan
<br />Commission, found and determined that the Area is and continues to
<br />be blighted, and adopted the Development Plan, as amended, for the
<br />Area; and
<br />WHEREAS, the Commission caused to be published a Notice of
<br />Public Hearing concerning the Area to be held on the 24th day of
<br />March, 1989, and filed by hand delivery a copy of that notice in
<br />the offices of the Plan Commission, the Board of Zoning Appeals,
<br />the Board of Public Works, the Park Board and the Building
<br />Commissioner; and
<br />WHEREAS, at the hearing held by the Commission on the 27th day
<br />of March, 1989, at 10:00 o'clock a.m., Eastern Standard Time, at
<br />1200 County -City Building, South Bend, Indiana, the Commission
<br />heard all persons interested in the proceedings and received �_
<br />written remonstrances and objections that had been filed, and
<br />considered those remonstrances and objections, if any, and such
<br />other evidence presented.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT
<br />COMMISSION, the governing body of the City of South Bend Department
<br />of Redevelopment and the Redevelopment District of the City of
<br />South Bend, Indiana, as follows:
