RESOLUTION NO.899 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT COMMISSION <br />DECLARING ITS INTENTION TO PURCHASE REAL ESTATE <br />COMMONLY KNOWN AS 126 NILES AVENUE, SOUTH BEND, INDIANA, <br />CW AND APPROPRIATING MONEY FOR SAID PURCHASE <br />WHEREAS, on December 16, 1986, the South Bend Board of Public <br />Works entered into a land contract agreement for the purchase of real <br />estate commonly known as 126 Niles Avenue, South Bend, St. Joseph <br />County, Indiana, which land contract is recorded in the Office of the <br />St. Joseph County Recorder as Document No. 8636566; and <br />WHEREAS, said land contract agreement was amended on February 3, <br />1987, which amendment is recorded in the Office of the St. Joseph <br />County Recorder as Document No. 8706320; and <br />WHEREAS, the South Bend Redevelopment Commission desires to <br />purchase said real estate; and <br />WHEREAS, the Board of Public Works desires to sell said real <br />estate to the Commission; and <br />WHEREAS, the Redevelopment Commission has received funds by <br />donation and such funds are available for the purchase of said real <br />Ce estate. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND REDEVELOPMENT <br />COMMISSION, AS FOLLOWS: <br />1. The South Bend Redevelopment Commission declares its <br />intention to purchase from the South Bend Board of Public Works real <br />estate located at 126 Niles Avenue, South Bend, St. Joseph County, <br />Indiana, and more fully described as follows: <br />A part of the Northeast quarter of Section 12, <br />Township 37 North, Range 2 East of the second <br />principal meridian, City of South Bend, Portage <br />Township, St. Joseph County, Indiana being Lot 92 <br />in the original plat of the Town of Lowell, and <br />described as follows: <br />Beginning at the Northwest corner of said Lot 92; <br />thence South 89 °58140" East, 165.69 feet, to the <br />West right -of -way of a 14 foot alley; thence South <br />0 004156" East, on said alley West right -of -way, 66 <br />feet; thence North 89 058140" West, on the South <br />GO boundary of said Lot 92, to the East right -of -way <br />of Niles Avenue, 165.77 feet; thence North <br />0 000125" West, on said East right -of -way, 66 feet, <br />to the point of beginning. <br />2. The Purchase Price shall be Fourteen Thousand Twenty Dollars <br />($14,020.00). <br />3. The amount of Fourteen Thousand Twenty Dollars ($14,020.00) <br />for said purchase is hereby appropriated from donated funds available <br />to the Commission. <br />4.
